A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A GRANT DEED
CONVEYING TO THE CITY OF ANliliEIM CERTAIN
REAL'PROPERTY FOR PUBLIC PURPOSES.
i~EREAS, the City of Anaheim did heretofore enter into
an escrow 1"1'i th James Donald Duval, at Bank of America National
Trust and Savings Association, Anaheim Branch, Anaheim, California,
for the purchase of the hereinafter described real property for
public purposes; and
WHEREAS, said Bank of America National Trust and Savings
Association is now ready to close said escrow and a deed has been
prepared conveying said property to the City of Anaheim, free and
clear of all encumbrances except all taxes for the fiscal year
1956-57, a lien not yet payable, and covenants, conditions, restric-
tions, reservations, rights, ric;hts-of-way and easements of record,
and one-half of all minerals lyin~ beneath the surface of said pro-
perty, the seller to have no right of surface entry in connection
with said mineral rights.
NOW, irHEREPORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the deed conveying the following described
property situated in the City of Anaheim, County of Orange, State
of Calirornia, to wit:
That portion of Section 9 in ~ownship 4 South,
Range 10 West, S.B.B. & M., in the City of Ana-
heim, County of Orange, State of California,
described as follows: Commencing at a point in
the northerly line of Lot L~, as shown on a
licensed surveyor's map of a portion of Section
9 made for F. W. Fleisclli~ann and filed in Book 1,
Page 56, Record of Surveys, in the office of the
County Recorder of said Orange County, 289.82
feet, more or less, westerly from the Center line
of West Street, as sh01m on said map; running
thence southerly parallel with the easterly line
of the West one-half of the Northwest quarter of
said Section 1176.4 feet, more or less, to the
southerly line of said Lot 4; thence '\,esterly
along said southerly line 464 feet, more or less,
to the true point of beGinning of the boundary of
the land herein described; thence northerly para-
llel with the easterly line of the West one-half
of the Northwest quarter of said Section 9,
1216.25 feet, more or less, to the northerly line
of said Lot 4; thence westerly along the northerly
line of said Lot 4, 480.89 feet, more or less, to
the northeast corner of Lot 3 of said Fleischmann
survey; thence southerly along the easterly line
of said Lot 3, 1257.7 feet, more or less, to the
southeast corner of said lot; thence, easterly
along the southerly line of said Lot 4, 482.55
feet, more or less, to tile true point of beginning.

8XCEPTING THEREFROH that portion thereof described
as follows: Beginning at the southeast corner of
the parcel hereinbefore described and running thence
northerly along the easterly line thereof 426 feet,

more or less; thence westerly parallel with
the southerly line of said parcel 482.55 feet,
more or less, to the westerly line thereor;
thence southerly along said westerly line 426
feet, more or less, to the southwesterly cor-
ner thereor; thence easterly along the south-
erly line 482.55 reet, more or less, to the
true point of beginning.
(Said property above described, conveyed by
said deed, contains 8.94 acres.)
to the City or Anaheim, rree and clear of all encumbrances,
except as hereinabove set rorth, be, and the same is hereby,
accepted by the City of Anaheim.
BE IT FURTHER RESOLVED that said escrow holder be,
and it is hereby authorized to deliver to said Vendor the amount
of the purchase price for said property heretorore deposited in
escrow, when all conditions or said escrow have been met and com-
plied with.
