RESOLUTION NO. 3539
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM RESCINDING RESOLUTION
NO. 3146 ENTITLED, "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF ANAHEIM AC-
CEPTING 'rHE GRANT FROH SOUTHERN PACIFIC
COMPANY OF A RIGHT TO CONSTRUCT, RECON-
STRUCT, MAINTAIN AND USE A SEWER LINE
IN AND ALONG PROPERTY OF Th'E GRANTOR;
AND AUTHORIZING THE EXECUTION OF AN IN-
DENTURE COVERING THE CONSTRUCTION, USE
AND MAINTENANCE OF SAID SEWER LINE."
WHEREAS, the City Council did on the 14th day of Feb-
ruary, 1956, adopt Resolution No. 3146 accepting the grant of
Southern Pacific Company of a right to construct, reconstruct,
maintain and use a sewer line in and along property of the
grantor therein described; and authorizing the execution of an
indenture coverins the construction, use and maintenance of
said sewer line; and
WHEREAS, the City Council finds that said grant from
the Southern Pacific Company of the right to construct, recon-
struct, maintain and use said sewer line above-mentioned is not
necessary nor required by the City of Anaheim and that Resolu-
tion No. 3146 accepting said grant and authorizing the execution
of the indenture above mentioned should be rescinded and that
the signatures of the Mayor and City Clerk affixed to said in-
denture should be deleted therefrom.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 3146 entitled, II A RESO-
LUTION 01<' THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING 'rHE
GRANT FROM SOUTHERN PACIFIC COMPANY OF A RIGHT TO CONSTRUCT, RE-
CONSTRUCT, VlliINTAIN AND USE A SEWER LINE IN AND ALONG PROPERTY
OF THE GRANTOR; AND AUTHORIZING THE EXECUTION 01<' AN INDENTURE
COVERING THE CONSTRUCTION, USE AN~ 11AINTENANCE OF SAID SEWER
LUrE," adopted b:r the City Council on the 14th day of February,
1956, be, and the same is hereby rescinded, and that the signa-
tures of the Mayor and the City Clerk be deleted from that cer-
tain indenture dated February 15, 1956 and referred to in said
Resolution No. 3146.
