RESOLUTION NO. 3501
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GEANTING A SPECIAL USE PERHIT TO
ORVAL R. SOMHERS'TEDT TO CONS'rRUCT A SWIMMING
POOL AND OPERATE A PRIVATE SIVINIHNG CLUB AND
SWIMHING SCHOOL.
WHEREAS, on or about the 16th day of August, 1956, the
City Planning Commission of the City of Anaheim did receive an
application from Orval R. Sommerstedt, 1621 West Southgate
Avenue, Fullerton, California, for a special use permit to con-
struct a swimming pool and operate a private swimming club and
swimming school on the following described property:
The East half of the East 20 acres of the
Southwest quarter of the Southwest quarter
of the Southwest quarter of Section 7, in
Township 4 South, Range 10 West,S.B.B.& M.
in the Rancho Los Coyotes, as shown on a
map thereof recorded in Book 51, page 7, et seq.,
Miscellaneous Haps, records of said Orange
County. Said property is located on the
North side of Lincoln Avenue approximately
660 feet East of Magnolia Avenue.
AND WHEREAS, said Planning Commission did thereupon give
legal notice that it would hold a public hearing in the Council
Chamber of the City Hall in the City of Anaheim on Tuesday, Sep-
tember 4,1956, at the hour of 2:00 o'clock P.M. to review said
application for said proposed use, and notified all interested
persons to attend said hearing and express opinions for or
against the granting of said special use permit, and did cause
said notice to be published on August 29, 1956, and did cause
notice thereof to be given by mailing a postal card notice not
less than ten (10) days prior to the date of such hearing to
the owners of property within a radius of 300 feet of the ex-
terior boundaries of the property for which such special use
permit was re~lested, using for that purpose the last known name
and address of such owners as shown upon the assessment roll of
Orange County, which said postal card did contain information as
to the time and place where said hearing would be held and the
purpose of said hearing, and notified all persons interested
therein to appear and express opinions either for or against the
grantin[: of said special use permit; and
AND TNHEREAS, on said 4th day of September, 1956, the City
Planning Cornmission did hold and conduct a public hearing upon
said application for said special use permit and did receive evi-
dence and reports from all persons who appeared at said meeting
and offered evidence or expressed opinions; and said Planning
Commission did thereupon adopt its Resolution No. 35 - Series
1956-57 recommending to the City Council of the City of Anaheim
that a special use permit be granted, subject to the conditions
therein set forth; and

WHEREAS, within 20 days from and after the date of the
adoption of said resolution, the City Council did elect upon its
own motion to review the action of the City Planning Commission;

~nEREAS, the City Council finds, arter careful considera-
tion or the recommendations or the City Planning Commission, thit
said special use permit should be granted upon the terms and con-
ditions hereinarter set rorth.
NOW, THEREFORE, BE IT RESOLV~~ by the City Council of the
City of Anaheim that the action or the City Planning Commission
granting a special use permit to Orval R. Sommerstedt, 1621 West
Southgate Avenue, Fullerton, California, to construct a swimming
pool and operate a private swimming club and swimming school on
the property hereinabove described, be, and the same is hereby
approved and that said special use permit be, and the same is
hereby granted subject to the rollowing conditions:
1. That the frontage alonS Lincoln Avenue
be suitably landscaped.
2. That the orr-street parking area be
black-topped.
The City Council hereby reserves the right to revoke such
special use permit ror good cause or failure or said owner or his
heirs, successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said special use
permit is granted ror the term prescribed by the Anaheim Munici-
pal Code unless otherwise speciried herein.
THE FOREGOING RESOLUTION is signed and approved by me this
9th day of October, 1956.
