RESOLUTION NO. 3507
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINALLY ACCEPTING THE COMPLETION
AND THE FURNISHING OF ALL PLANT, LABOR, SER-
VICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES
AND TRANSPORTATION INOLUDING POWER, FUEL AND
WATER, AND PERFORMING ALL WORK NECESSARY TO
CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC
IMPROVEMENT: THE FOREST-LOUISE SEWER EXTENSION,
FROM 214 FEET WEST OF LOUISE DRIVE ON }'OREST
LANE TO 90 FEET SOUTH OF ROMNEYA DRIVE ON
LOUISE DRIVE, JOB NO. 1071
WHEREAS, the City Council of the City of Anaheim did oause to
be published in a newspaper of general oi~oulation, printed, pUblished and
oiroulated in the Oity of Anaheim, to wit: The Anaheim Bulletin, on the
14th and 21st days of August , 19 56 ,a notice inviting
sealea proposals for furnishing the following:
All plant, labor, services, materials and equipment, and
all utilities and transportation, including power, fuel
ane. w&ter, and performing all vlork neoessary to oonstruct
and, complete in & good and workmanlike manner, in striot
accordance with the specifications, plans and drawings
therefor on file in 'the Office 'Of the City Clerk of the
City 'Of Anaheim, the followi~; public impravement, to wit:

in aocordanoe with the designs, plans, profiles and speoifioations pre-
pared by George E. Holyoke, City Engineer and the notioe inviting
sealed proposals, whioh said notioe speoified that sealed proposals as
specified in said notice would be received up until 7:00 a'clook P.M.
of the 28th day of Au~st , 19 56 ,and which said notice
did state and deolare that, pursuant to the provisions of Section 1770 of
the Labor Code, the City Counoil of the City of Anaheim had ascertained
the prevailing rate of wages for each type of labor needed to exeoute
said contract and did set forth the prevailing hourly wage scale so ascer-
tained; and

WHEREAS, at a regular meeting of the City Counoil held on the
28th day of August ,1950 ,at the hour of 7:00
o'olook P.M. of said date, said City Counoil did hold a pUblio hearing
for the purpose of opening sealed proposals reoeived up to that time, for
furni~hing of all plant, labor, services, materials,and equipment, and all
utilities and transportation, inoluding power, fuel and water, and per-

forming all work neoessary to oonstruot and complete, in a good and
workmanlike manner, in striot aooordance with the specifications,
plans and dr'awlngs therefor on file in the office of the Oity Clerk
of the City of Anaheim, of the publio improvement hereinabove more
partioularly described and set forth; and
WHEREAS, the City Council did thereupon refer said bids to
the City Engineer for examination
tabulation and report to the Oity Counoil, and said City Engineer
did thereupon examine and tabulate said sealed
pr~osals and report the result of his tabulation to the City Oounoil;

WHEREAS, the City Counoil did meet io regular
ses.slon on the 28th day of Augus t , 19 56 ,at the hour
o~ 7:00 o'olook P.M. to oonsider the sealed proposals submitted
for furnishing materials and performing the work hereinabove more
partioularly desoribed and set forth, and the City Engineer
of the Oity of Anaheim did thereupon make his
report and submit his tabulation of said sealed proposals, and the
City Oounoil did thereupon find and determine that the sealed proposal
submi tted by PLUlvLBING CONTRAC'rORS. INC.. SANITA:.qy DIVI SION.
for the construction, installation and oompletion of said

hereinabove mentioned and desoribed was the lowest responsible pro-
posal submitted therefor, and thereupon acoepted said bid and did
aw~d a oontract to saidPLUMBING CONTRACTORS, INC.. Sk~ITARY DIVISION
for furnishing all plant, labor, services, materials aod equipment
and all utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and oomplete, in a good
and workmanlike manner, in strict accordance with the specifioations,
plans, and drawings, the said publio improvement as speoified in said
notioe inviting sealed proposals, and did authorize the Mayor and the
City Clerk of the City of Anaheim to execute a contract for and on
behalf of the City of Anaheim with PLUMBING CONTRACTORS, INC.,
SANITA:.:rf DIVI SION , which said oontraot was duly
made and entered into on the 30th day of August
19~; and
WHEREAS, the said PLm1BING CONTRACTORS, INC. ,SANITA..RY DIVISION
has furnished all plant, labor, servioes, materials and equipment and
all utilities and transportation, and performed all work necessary
for the oonstruotion and completion, in a good and workmanlike manner,
in strict accordance with the speoifioations, plans, drawings, of said
public improvement as speoified in the notioe inviting sealed proposals
and in the detail, design, plans, profiles, drawings and speoifioations
prepared by George E. Holyoke, City Engineer , and the contraot
made and entered into with it by the City of Anaheim; and
WHEREAS, the City Engineer
has duly oertified to the construotion and completion of said pUblio
improvement hereinabove mentioned and desoribed in aooordance with
the plans and speoifications and the contraotdoouments dUn~vf~1AMand
entered into with said PLU~ffiING CONTRACTORS,INC.,SANITARY f ~d
WHEREAS, the City Council finds that said oontraotor has oom-
pleted said public improvement hereinabove more partiou1arly desoribed
in accordance with the provisions of the contraot and the oontract
documents, and that notice of completion should be filed and payment
of the balance due said contraotor authorized in aooordanoe with the
contraot doouments.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City
of Anaheim that all plant, labor, servioes, materials and equipment

and all utilities and transportation, and the performanoe of all
work necessary to construct, install and complete, in a good and
workmanlike manner, in striot aocordance with the, speoifications,
plans and drawings therefor on file in the offioe' of t~eCity
Clerk of the City of Anaheim, together with the a~purtenances
thereto of said public improvement hereinabove more partioularly
desoribed and set forth, in the City of Anaheim, by said 'con-

documents, and that the balance due said contraotor for said work

acoeptance of said work as eVidenoedby the adoption of this
resolution, but not sooner than :thirty (30) days after the date
of the filing of notioe of oompletion, excepting only suoh sum
or sums as may lawfully be withheld in aocordance with the pro-
visions of said oontract and contraot doouments. That acceptance
by the oontractor of said payments made in accordance with said
final estimate shall operate and shall be a release to the City of
Anaheim, its offioers, agents and employees from all :claims and
liabilities due the oontractor for anything done or furnished or
wi1J!1he1.d tsi' fer any'thin:grelating to the work or any aot or neg-
leot of the City, its officers, agents and employees, excepting
only claims agains15 the,City for any amounts wf1fftheld by the City
at the time of suoh payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
to execute and file a notioe of completion of said work as required
by law.
THE FOREGOING RESOLUTION was signed and approved by me
this 9th day of October , 19 56 .
