1960-6045RESOLUTION NO, 601 -5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article.IX Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (!O) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the day of mpy� 1960 9 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article. IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission;: and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop- erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: The Southerly 200 feet of the Westerly 280 feet of the Southerly 8t acres of the Westerly one -half of the Southwest quarter of the Southeast quarter of Section Twenty, Township Four South, Range Ten West,S.B.B.& M., in the Rancho Los Coyotes. F- 5 9 -60 -9 be changed from R -1, ONE FAMILY RESIDENTIAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That subject property be developed in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That residential standards be maintained on both Katella Avenue and Nutwood Street. 3. That a concrete masonry wall six feet in height be con- structed along the boundary between this property and any adjacent R -1 zoned properties. 4. That the owners of subject property deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Katella Avenue, and a strip of land 32 feet in width, from the center line of the street, along Nutwood Street, for street widening purposes. 5. That all engineering requirements of the City of Anaheim, along both Katella Avenue and Nutwood Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 6. That a bond in an amount and form satisfactory to the City of Anaheim. be posted with the City to guarantee the installa- tion of said engineering requirements above mentioned and said 6 -foot concrete masonry wall. 7. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot along both Katella. Avenue and Nutwood Street for street widening purposes. 8. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall provide that all exterior lighting for parking lots or other purposes shall be in- stalled so that the light will not shine into any of the adjacent R -1 zoned properties; that no public address or speaker system shall be permitted on the exterior of the buildings; and that any buildings constructed on subject property shall be limited to one story, not exceeding 20 feet in height. 9. That all of the above conditions, with the exception of Conditions Nos. 1, 2, 3, and 5, be complied with within a period of 90 days from date hereof. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
