1960-6044RESOLUTION NO, 6A L._ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public heari:•g thereon in the manner and as prescribed in Ar°ticle Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public hearing to consider said proposed change of zone or zoneri and did rec ;ive evidence and reports from persons inter -steel therein; and WHEREAS within a period of forty (40) days following the final hearing thereon the Planning Commission did duly announce by formal resolution its findings of fu:.ots and declare it opinions and reasons for recommending an ame dmer t said Article IX Chapter 2 of the Anaheim Municipal Cod to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS upon receipt of the r: port and recommendation of the City Planning Commission the City Council did thereupon fix the 3 1st day of Nay 9 1960 9 as the time and the Council CounTinaiber in the ity a 1 of thTty of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX Chapter 2 of the Anaheim Municipal Code; and WHEREAS at the time and place fixed for said public hear= ing the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did reoeive evidence and reports and did thereupon con- sider the recommendations of the City Planning Commission;. and WHEREAS the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone as hereinafter set forth is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones, NOW THEREFORE,, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim County of Oran ge State of California described as follows: to wit: F -59- 60 -98 Beninning at the intersection of the Westerly line of Los Angeles Street with the Northerly line of Proad Street (now Vermont Avenue.) as said streets are shown On a map of knabeim recorded in hooi7 I panes 629 and 630 of Deeds, records of Los Angeles County California, and running thence South 7 'lest, along said Norti line of Broad Street, 296.10 feet thence North 15' West 229.)!C feet; thence North 711- East 299.05 feet to said Westerly line of Los Angeles Street; thence South 15- East, al ong said Westerly line ,229.)C feet to the point of beginning; EXCEPTING THEREFROk that portion thereof described as beginning at the intersection of the center line of Los Angeles Street with the center line of Vermont Avenue, as shown on a me p of Tract No. 1194, recorded in hook 13, page 2, Niscellaneous haps, rec)rds of said Orange County, and running thence South 7h 21 13" West, along the center line of Vermont Avenue, 190 feet; thence North 15 30 1_,-"5" West 1 54 feet; thence North 7 21 15" 'Fast 190 feet to the center line of Los Angeles Street; thence South 15 36t 155" East along said center line, 154 feet to the point of beginning; be changed from 2-3, MULTIPL-FA1 RESIDENTIAL ZONE to C-1, NEIGEBCRHOOD-COMTTRCIAL ZONE', upon the following conditions: 1. That subject property he developed in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land )_LF: feet in width, from the center line of the street, along Los Anneles Street, for street widening purposes. That all existing street improvements along Los Angeles Street be removed, and that all engineering requirenents of the City of Anaheim, along Los Angeles Street, such as curbs and gutters, sidewalks, street grading and Paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer. d. That sidewalks be installed along. Vermont Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee tbe removal of the existing street improvements along Los Angeles Street, and the installation of the above mentioned engineering requirements along Los Angeles Street and sidewalks along Vermont Avenue. 6. That the owners of subject property pay to the City of Anaheim the sum of $2.c0 per front foot, alongVermont Avenue, for street lighting purposes. That the owner of subject property place of record standard City of Anaheim 0-1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of -2- ATTEST: (SEAL) the property to nanhs, Business Offices, Medical and Dental Offices, Pharmacies, Professicnal Offices, Non-Retail Service Businesses, and any uses except Restaurants, which may hereafter be a.uthori zed and permitted under future zoning of the City of Anahei.r in the proposed C -7, Business and Professional Cffice Zones. That all of the above conditions, wi th the exce,:_ ion of Conditions No. 1, 3 and 1 he complied with within a period of 90 days from date hereof, or such further time as the City Council may grant BE IT FURTHER RESUMED that the City Attorney he, and he is hereby authorized and directed to prepare and submit to the C i t y Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
