1960-5978WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentio ed and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article_IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zoa and did r oeive evidence and reports from persons inter stsd therein and WHEREAS, within a period of forty (10) day following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of fact: d do oiler its opinions and reaso• s for recommending an ame.dment t:l said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed change in the b undaries of th zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, th City Council did thereupon fix the 3rd day of May 19 60 s the time and the Count Chamber in the Citya ®f th; Crty of Anaheim as the place for a public hearing upon said prcposd oh_ -nge of zone, a did give notice thereof in the manner nd as pro ided in said Article. IX, Chapter 2 of the Anaheim Munic ,p« 1 Code and WHEREAS, t the time and plaoc_ fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons into; eated th rein an pportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planni.,:g Commission; and WHEREAS, the City Council doe find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zone will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as followsg to wit RESOLUTION NO, 5978 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. olo That portion of the West half of the Southeast quarter of the Southeast quarter of Section 15, in Township Z;_ South, Range 11 West, San Bernardino Base and Meridian, in the City of Anaheim, described as follows: F- 59 -60 -88 Beginning at a point on the South line of the West half of the Southeast quarter of the Southeast quarter of said Section 15, 166.67 feet West of the Southeast corner thereof, and run- ning thence West along the South line of said West half, 116.50 feet; thence North parallel to the West line of said West half, 401.98 feet to a point on the Southerly line of the right of way of the Pacific Electric Railroad; thence Southeasterly along said Southerly richt of way line 145.34 feet; thence South parallel to the West line of said West half, 314.46 feet to the point of beginning. be changed from R -A, RESIDENTIALL- AGRICULTURAL ZONE, to C -1, NEIGHBORHOOD COMMERCIAL ZONE 9 upon the following conditions: 1. That subject property shall be developed in accordance with the plans submitted and on file with. the City of Anaheim.. 2. That the owner of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Bali Road for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accord- ance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. L That the owner of subject property pay to the City of Anaheim. the sum of $2.00 per front foot for street lighting purposes. 5. That the owner of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney. 6. That conditions Nos. 2, 3(b), 4 and 5 above ment5oned be complied with within a period of ninety (90) days from date hereof, or, such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper, THE FOREGOING RESOLUTION is signed and approved by me this 3rd day of May 9 19 60 0 ATTEST: -2- MAY OF HE CITY OF ANAHEIM STATE OF CALIFORNIA COUNTY OF ORANGE ss.
