1960-5968RESOLUTION NO. el- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ,ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, th City Planning Commission of the City of Anaheim has heretofore duly pas.ed and dopted a resolution declar- ing its intention to change the bound -ries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon; in the manner and as prescrib d in Article IX, Chapter 2 of the Anaheim Municipal Cod did duly hold and conduct such public hearing to consider said proposed change of zone or zone and did r: c waive evidence and reports from persons inter.st d therein; and WHEREAS, within a period of forty (4 day following the final hearing thereon, the Planning C,mmission did duly announce by formal resolution its findings of facts and declare; its opinions and reasons for re©omm- ;nding En amen ent t said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the bundaries of the zone hereinafter mentioned and described; and WHEREAS, upon rr_;cipt of th r. ;port and recommendation of the City Planning Commission, the City Council did thereupon fix the 26th day of April 1960 as the time and the Ch Count amber in the city -ate Wf thty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as pro>ided in said Article IX, Chapter 2 of the Anaheim Municipal C c and WHEREAS, at the ti =e and place fixed for said public hear- ing, the City Council did duly hold a conduct such public hearing and did give all persons inters t therein an pportunity to be heard and did receive evid:nce and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS the City Council doe find and determine that the property and are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: i=- 5 b0 -57 That portion of Lot 26 of Anaheim Extension, as shown on a map of survey made by William Hamel, and filed in the Office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the intersection of center lines of Lemon Street and Ball Road and running thence Northerly, along said center line of Lennon Street, 211.89 feet; thence Easterly, at right angles to said center line, 277.82 feet; thence Southerly, parallel with said center line of Lemon Street, to said center line of Ball Road; thence Westerly, along said center line, to the point of beginning. be changed from C -1, NEIGHBORHOOD- COP7vERCIAL ZONE and P -L, PARKING-LANDSCAPING- ZONE to C -1, NEIGHBORHOOD -COP ERCIAL ZONE, upon the following conditions: 1. That the owner of subject property deed to tre City of Anaheim a strip of land 3 feet in width, from the center line of the street, along Ball Road for street widening purposes, and a strip of land 32 feet in width, from the center line of the street, along Len on Street for street widening purposes. 2. (a) That sidewalks be installed along Bali Road and Lemon Street, as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer; and (b) that a bond in an amount and form satis- factory to the City of Anahe irr. be posted with the City to c_uarantce the installation of said sidewalk requirements. 3. That the owner of subject property pay to the City of Anaheim the sun; of $2.00 per front foot along both Ball Road and Lemon Street, for street lighting purposes. L. That subject property be developed in accordance with the plan this day submitted to the City Council, marl -ed "Flan A," and on file with the City of Anaheim. 11. That the Traffic Engineer of the City of Anaheim shall determine the flow of traffic from subject property onto Lemon Street, and the matter of left hand turns from said property onto Lennon. Street shall be left to the discretion of said Traffic Engineer. 6. That a 4 -foot wall be constructed along Lemon Street north. of the driveway to be located north of the building, and west of and opposite the service area. 7. That planting areas be established and maintained as shown on "Plan A" on file with the City of Anaheim. -2- ATTEST: 6. That all of the above conditions with the exception of Conditions Nos. 2(a), Li, 5, 6 and 7 be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
