1960-5967A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Pl::n,ing Commis-in of the City of Anaheim has heretofore duly pas and ..dopted a resolution declar- ing its intentio to change the boundaries of the zone or zones hereinafter mentio:•.ed and described and did fix time and place for the holdi;g of a public hearing thereon in the manner and as prescrib d in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public h. ring to consider said proposed change of zone or z0D F, and did me t;i e evidence and reports from persons inter st:; d th rein; and WHEREAS, within a period of forty (4O) day, following the final hearing thereon the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reaso: s for recomm- :nding an amen. =lent to said Article IX, Chapter 2 of the Anaheim Nunicip-.1 Code to effect the proposed changes in the b undaries of the z ne hereinafter m,vntioned and described; and RESOLUTION NO. 5967 elo WHEREAS, upon r.ceipt of the report and recommendation of the City Planning Commission, th City Council did thereupon fix the 26th day of A r i l 19 60 a as the time and the Counciber in the ter' aa th ;qty of Anaheim as the place for a public hearing up -n :,aid proposed change of zone, and did give notice thereof in the m -nner +:d as propided in said Article IX, Chapter 2 of the Anaheim Municip< 1 Cod 9 and WHEREAS, at the ti and place fix for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all person int rs ted therein an opportunity to be heard and did receive evidence and reports, a :d did thereupon con- sider the recommendations of the City Planni:.fg Commission a and WHEREAS, the City Council does find and determine that the property and are c:. proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop arty and area in such new zone or z nes will increase the value of said property and area and will not d-.precoiate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by th City Council of the City of Anaheim that all of the property and ar =:a situated in the City of Anaheim, County of Orange, Stag of California, described as follows to wit. F- 59 -60 -85 The Easterly Half of that portion of the South Half of the Southeast Quarter of the Southwest Quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 1, Page 11 of Miscellaneous Maps, in the Office of the County Recorder of said county, described as follows: Beginning at a point on the South line of said South- west Quarter, West 110.00 feet from the Southwest corner of the East 5 acres of said South Half; thence North parallel with the West line of said East acres to the South line of Tract No. 2228, as shown on a map recorded in Book 69, Pages 3)1 through 37 inclusive of Miscellaneous P-aps, in the Office of the County Recorder of said County; thence West 217.00 feet along the South line of said Tract No. 2226; thence South parallel with said West line of the East 5 acres to the South line of said Southwest Quarter; thence East 217.00 feet to the point of beginning. Said land is a portion of the area shown on a map filed in Book 19, Page 6 of Record of Surveys, in the office of the County Recorder of said county. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following condi- tions: 1. That the property be developed in accordance with the plans presented to the City Council and on file with the City of Anaheim, EXCEPT that all buildings shall be limited to one story in heinht. 2. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road, for street widening purposes; and a strip of land 20 feet in width along the rear property line for alley purposes. 3. (a) That all engineering requirements of the City of Anaheim along Ball Road and for the 20-foot alley along the rear property line, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. It. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 5. That the owners of subject property pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation pur- poses, said sum to be paid at the time the building permit is granted. 6. That the owners of subject property place of record standard City of Anaheim R -3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit all buildings erected on the property to one story in height. 7. That all of the above conditions, with the exception of Conditions Nos. 1, 3(a) and 5, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
