1960-6315RESOLUTION NO. 6315 -1- Copies to: Finance Right -og -way A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, GIACOMO LUGARO and AGOSTINA LUGARO, husband and wife, are the owners of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of California; and WHEREAS, said owners have offered to sell said property to the City of Anaheim for the sum of $37,34. cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and ac- quisition of said real property for municipal purposes, and that the price which the owners thereof are willing to accept is reas- onable and not out of proportion to the fair market value of said lroper ty. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Giacomo Lugaro and Agostina Lugaro, husband and wife, to sell to the City of Anaheim all that real property, situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the West 16.58 acres of the Northwest quarter of the Southwest quexter of Section 7, Township 4. Sout li, Range. 10 West, in the Rancho Los Coyotes, as shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the center Line of Magnolia Street distant South 00 13 45" East 1078.01 feet from the intersection of said Magnolia Street with the center line of Crescent .Avenue as said intersection is shown on a map of Tract No. 2721, recorded in Book 110, Pages 13 and 14 of Miscellaneous Maps, records of Orange County, California; thence North 88° 56= 54" East 153.01 feet; thence North 54° 04' 04" East 145.30 feet; thence North 00 13' 45" West 66.90 feet; thence North 88° 56: 54" East 92.00 feet; thence North 66° 31' 14" East 202.4 feet to a point in the Easterly line of said West 16.58 acres which is South 00 23' 02" East 85.00 feet from the Southwest corner of said Trac No. 2721; thence South 00 23' 02" East to the Northwesterly line of the Orange County Flood Control District right of way as described in a deed recorded April 1, 1960 in Book 5175, Page 274 of Cff is ial Records; thence South 50 07' 52" West along said Northwesterly line to the Southerly line of the Northwest quarter of the Southwest quarter of said Section 7; thence along said South line South 38° 56' 54" West to said center line of Magnolia Street; thence North 00 13' 45" West 250.00 feet to the point of beginning.; for the sum cf $37,340.50 cash, lawful money of the United States, be, and the same is hereby, accepted subject to the following terms and conditions: BE IT FURTHER RESOLVED that the City Manager of the City of Anaheim be, and he is hereby, authorized for and on behalf of the City of Anaheim to sign escrow instructions for the purchase of said real property and to enter into an escrow with the owners of said property at California Bank, Anaheim Office, Anaheim, California. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, avtorized to der)os't in escrow at said Cal- ifornia Bank $37,340.50 cash, lawful money of the United States, to be paid to the owners of said real property when a deed con- veying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be re- corded and a policy of title insurance issued by a reputable title company, showing said property vested in the City of Anaheim as hereinabove specified. AND BE IT FURTHER RESOLVED that the sellers shall pay the usual and customary sellers! charges for furrishing a policy of title insurance necessary to show title vested in the City of Anaheim, as herein provided, and that the City of Anaheim shall pay the usual buyer's charges in the purchase of said property. THE FOREGOING RESOLUTION is approved and signed by me this 27th day of September 1960, That said property shall be conveyed to the City of Anaheim free and clear of all encum- brances except all general and special taxes for the fiscal year 1960-61, including any special district levies, payment of which is included therein and collected therewith; all taxes and assessments levied or assessed subsequent to the date the escrow, hereinafter referred to, is entered into between Buyer and Sellers; and all covenants, conditions, restric- tions, reservations, rights, rights of way and easements of record approved by the City Attorney. 7ttY OF ANAHErn STATE OF CALIFORNIA) COUNTY OF ORANGE ss. WILLIAMS, City Clerk of the City of Anaheim, do hereby certify that the foregoing Resolution No. 6315 was introduced and adopted at a regular meeting provided by law, of the City Council of the City of Anaheim, held on the 27th day of September, 1960, by the following vote of the members thereof: AYES: COUNCILMEN: Chandler, Coons, Fry, Thompson and Schutte NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said Resolution No. 6315 on the 27th day of September, 1960.
