1960-6199RESOLUTION NO, 6199 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINALLY ACCEPTING THE COMPLETION AND THE FURNISHING OF ALL PLANT, LABOR bERVICES MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION INCLUDING POWER, FUEL AND WATER AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT TO WIT AAVF_ W R MP's 7 �QaNl18�_ WHEREAS the City Council of the City of Anaheim did cause to be published in a new paper of general circulation,. printed published and circulated in the City of Anaheim, to wit: The Anah Gazette sew zzette n March 2 th and A•r i l 1st 19 y ed proposa s _'or urn's ng e fol All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The Placentia Avenue Sewer Improvement, consisting of the construction of an 8-inch V.C.P. sewer lateral, complete in place, in Placentia Avenue, from Sycamore Street to approximately 500 feet south of Sycamore Street, in the City of Anaheim, including trenching, backfill, resurfacing, manholes, wyes and appurtenant work,as more particularly set forth in the plans and specifications on file in the Office of the City Engineer, Job No. 1183; in accordance with the design plans, profiles and specifica- tions prepared by u f _._.E P e._.__a1 1 C i t y Eno ineer and the notice inv'ting sea e• propose. s which said notice specified that sealed proposals as specified in said notice would be received up until 2:00 ovclock P0M0 of the 7th day of April 9 7 61.0 and which said notice did state an dec are that, pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rat of wages for each type of labor needed to execute said contract and did set forth the prevailing hourly wage scale so ascertained; and WHEREAS, on April 7th 19 60 at the hour of 2 :00 o'clock QMo th ty erk amity Engineer of the City of Anaheim did open s4'id sealed proposals received up to that time for th 4,. furnishing of all plant, labor, services, materials and “Iuipment, and all utiliti.s and transporttion including power, fuzl and wnter, aen:i performing all work neces- sary to construct and complete, in a good and workmanlike manner, in strict 1,ccordance with the specifications, plans and drawing e therefor on file in the Office of the City Clerk of the City of Anaheim, the public improv:ment hereinabove more parti- cularly describd Id set forth, in public, in the City Council Chamber in the- City Hall, Anaheim, California, and the City Engineer did tbulate the result of said sealed proposals and did make a rep.rt to the City Council at its next regular meeting; and WHEREAS, the City Council of the City of Anaheim did at its next regular meeting, held on the 12th day of 1 l960 at the hour of ovclock .M. consisiF ls submitted TV ur- nishing the materials and performing the work hereinabove more particularly described and set forth, and did thereupon find and determine that the sealed proposal submitted bv BAR-ROC CONTRACTORS, INC., 12101 Garden Grove Blvd., oa r&e'zn-r.767777-7677T. Tor the construction; instarition an comp et on o sa'. -1 0 o. ace114 Avenue Sewer Improvement from S camore St. a SO rox. 00' here nabove mentioned and describ=d wa s the lowest r ponsib e proposal submitted thersigr, and thereupon accepted said bid and did award a contract to said BAR-ROC CONTRACTORS INC. for furnishing all plant, labor„ serviees, ma'teriais and equiT ment and all utilities and tran pertation, including power, fuel and water, and performing all work netessary to construct and complete, in a g*od and workmanlike manner, in strict accordance with the pecifioations, plans, and drawings, the said public improvement as spec!fied in said notice inviting sealed proposals, and did authorize the Mayor and the City Clerk of the City of Anaheim to execute a contract for and on behalf of the City of Anaheim with BAR-ROC CONTRACTORS, INC. which said contract w:sMjiTde and anterea on day of April 19 60 and WHEREAS, the said BAR-ROC CONTRACTORS, INC. has furnished a 1 p ant abor sery ces materia a and :quipmvnt and all utilities and transportation and performed all work necssary for the construction and completion, in a good and workmanlike mnner, in strict accordanc with the specifications, plans, drawings, of sEcYd public improvement a specified in the notice inviting sealed proposals and in the detail, d signa,plans, profiles, dr wings and specification- pre- pared by Thornton E. PiersaIl Cit.\ Engineer 9 and the contract ma and entzred into w y he City of Anaheim; and -2- canc013===1=0=01=GL..9 WHEREAS, the _City En ineer ,has duly certified to the con r iird struction an comp etion of im- provement hereinabove mentionAd and described, in accordance with the plan and sp cifications and the contract documents duly made and entered into with said BAR-ROC CONTRACTORS INC. and WHEREAS, the City Council finds that said contractor has completed said public improverint hereinabove more particularly described in accordance with the provisions of th e contract and the contract documents, and that notice of completion should be filed and payment of the balance due said contraotor'authorized in accord= ance with the contract documents, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of An helm th =:t all plat, labor, services, materials and equipment and all utilities and transportation, and the per- formance of all work neccess ry to construct, install and complete, in a good and workmanlike rte:- ::naer, in strict accordance with the specifications, plans and drawings there=for on file in the Office of the City Clerk of th City of Anaheim, together with the appurtenarnc:s thereto, said public improvement hereinabove more particularly described and s t forth, in the City of Anaheim, by said contractor, be and thi- same re hereby accepted, subject, nevertheless, to 11 the t: rms, conditions and provisions of the contract documents, and that the balance due said contractor for said work be paid to it thirty -five (35) days from and after final acceptance f sa work as =;videnced by the adoption of this resolution, but not sooner than thirty (30) days after the date of the filing of notice of completi>n, excepting only such sum or sums as may lawfully be withheld in accordance with the provisions of said contract and c }ntrac;t documents.
