1961-6581RESOLUTION NO, 6581 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ing F 60 to consider an amendment to Title 18 of the Anaheim Municipal Code relating.to zoning and to con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did flit the 3rd day of J qr�ua yy 1961 as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the lace for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the in- corporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following described property: -1- F- 60 -61 -45 Commencing at the intersection of the center lines of Harbor Boulevard and Wilken Way, said intersec- tion being the true point of beginning, and running thence Southerly along the center line of said Harbor Boulevard, a distance of 237 feet to a point; thence Easterly along a line perpendicular to said center line of Harbor Boulevard, a distance of 300 feet to a point; thence Northerly along a line parallel to said center line of Harbor Boule- vard, a distance of 225 feet, more or less, to the center line of Wilken Way as now established; thence Westerly along the center line of Wilken Way as now established, a distance of 300 feet, more or less, to the point of beginning; EXCEPTING THEREFROM the Westerly 40 feet thereof, now lying within Harbor Boulevard as now established, be excluded from the C -2, GENERAL COMMERCIAL and P -L, PARKING LANDSCAPING ZONES and incorporated in the following zone or zones: C -3, HEAVY COMMERCIAL ZONE, upon the conditions herein- after set forth: That portion of the Southeast quarter of Section 27, Township 4 South, Range 11 West, in the Rancho Las Bolsas, City of Anaheim, County of Orange, State of California, as per Map recorded in Book 51, Page 10, Miscellaneous Maps, in the office of the County Recorder of said Orange County, described as follows: 1. That the uses of subject property be limited to a service station and any C -2 uses; and that, if said property is utilized for any uses permitted in a C -2 Zone, the P -L Zone must be maintained. 2. That subject property be developed sub- stantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 3. That the owners of subject property place of record standard City of Anaheim C -3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of said property to a service station and any C -2 uses. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
