A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING
TO THE CITY OF ANAHEIM AND ANAHEIM UNION
WATER COMPANY CERTAIN REAL PROPERTY FOR AN
EASEMENT FOR PUBLIC UTILITY PURPOSES.
WHEREAS, the City of Anaheim and Anaheim Union Water
Company are desirous of purchasing the hereinafter described
real property for municipal purposes, to wit: An easement for
public utility purposes; and
WHEREAS, the owner of said property has offered to
sell and convey the same to the City and said Water Company;
and
WHEREAS, the City Council of the City of Anaheim
finds that it is for the benefit and best interest of the City
of Anaheim to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of WILLIAM GUTOSKY, a
single man, to sell to the City of Anaheim and Anaheim Union
Water Company the following described real property situated
in the City of Anaheim, County of Orange, State of California,
to be used for an easement for public utility purposes, and
more particularly described as follows:
Perpetual easements in, on, under, over and
across said five foot strip of land to install,
construct, inspect, maintain, repair, replace,
improve, relocate and remove pipe line or pipe
lines, storm drains, sewer lines and pole lines,
with incidental purposes and connections in, on,
over, under and across said five foot strip of
land, and to use said pipe line or pipe lines,
storm drains, sewer lines and pole lines,
appurtenances and connections, for distribution
and transmission and use of water for irrigation
and domestic purposes, sewer and water, disposal,
power transmission and telephone communication together
with reasonable rights of entry to said five foot
strip of land for the exercise of the rights herein
granted.
Grantor, for himself and his successors in
ownership of said five foot strip of land,
hereby acknowledges that use of any part or
all of said strip, or the adjoining lands, for
fences, structures, trees and other things now
and hereafter on any part of said strip
constituting an interference with the exercise
of any of the easements and rights granted by
this deed, exist and will continue to exist,
by permission of Anaheim Union Water Company and
the City of Anaheim, and not adversely to any
of said easements, and each successor in
interest of the grantor, by acceptance of a
conveyance of said strip of land, admits and
agrees that any such use is a continuing

be, and the same is hereby, accepted by the City Council of
the City of Anaheim, and that the City of Anaheim accept a
conveyance of said property.
BE IT FURTHER RESOLVED that the City Auditor of
the City of Anaheim be, and he is hereby, authorized to
pay to the owner of said real property, out of General
Funds of the City of Anaheim, the sum of One Dollar ($1.00)

The South 5 feet of Lots Ten and Nineteen
of Tract No. 3251, as shown on a Map
recorded in Book 100, pages 17 and 18 of
Miscellaneous Maps, records of Orange
County, California;
