1960-6540RESOLUTION NO. 6540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 93 TO PROVIDENCE FARMING COMPANY, PERMITTING A WAIVER OF HEIGHT AND GARAGE REQUIREMENTS ON THE PROPERTY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from Providence Farming Company, 1741 South Euclid Avenue, Anaheim, California, for a Conditional Use Permit to allow construction of three -story apartment buildings on the property hereinafter described, and permitting a waiver of the garage requirements and the con- struction of carports. Said property on which said Conditional Use Permit is requested is described as follows: That portion of the Northeast quarter of the Northwest quarter of Section 21, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, as shown on, a map thereof recorded in Book 51, Page 10, Miscellaneous Maps, Records of said Orange County, described as follows: Beginning at a point in the West line of said Northeast quarter, distant thereon North 0 01' 34" East 496.05 feet from the Northwest corner of Tract No. 1979, as shown on a map thereof recorded in Book 89, Pages 2 to 5 inclusive, Miscellaneous Maps, Records of said Orange County, and running, thence North 89 26' 50" East 170.00 feet to a point in the West line of the land conveyed to Anaheim Union High School District of Orange County, by deed dated August 22, 1960, and recorded in Book 5383, Page 168, Deeds, Records of said Orange County; thence North 0 01' 34" East, 1.70 feet to an angle point in the West line of the land described in said deed to the Anaheim Union High School District; thence North 89 26' 50" East, 566.86 feet, more or less, to a line which is parallel with, and distant 550.00 feet Westerly from the West line of the right of way of the Southern Pacific Railroad, 60 feet wide; thence Northerly along said parallel line, 833.30 feet to the North line of said Northeast quarter; thence along said North line, South 89 26' 50" West 450.15 feet, more or less, to a line which is parallel with, and distant 284.00 feet Easterly from the West line of said North- east quarter; thence along said parallel line, South 0 01' 34" West 459.00 feet; thence South 89 26' 50" West parallel with the North line of said Northeast quarter, 284.00 feet to the West line of said Northeast quarter; thence along said West line, South 0° 01' 34" West 376.02 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on November 21, 1960, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 125 Series 1960 -61, granting Conditional Use Permit No. 93, upon the conditions therein set forth; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 13th day of December, 1960 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. -2- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission in granting said Conditional Use Permit be sustained and that Conditional Use Permit No. 93 be and the same is hereby granted to Providence Farming Company, 1741 South Euclid Avenue, Anaheim, California, permitting the construction of three -story apartment buildings and a waiver of the garage requirements and construction of carports on the property hereinabove described, subject to the following conditions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street along Bali Road, for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 4. That the owners of subject property pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation pur- poses, said sum to be paid at the time the building permit is issued. 5. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 6. That Conditions Nos. 2, 3(b) and 5 hereof be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
