1960-6465RESOLUTION NO, 6465 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING ITS POLICY FOR THE USE OF LA PALMA STADIUM AND ESTABLISHING A SCHEDULE OF FEES TO BE CHARGED FOR ITS USE. WHEREAS, the La Palma Stadium is a City -owned stadium designed for use for events involving large groups of spectators; and WHEREAS, said stadium was built to serve the residents and citizens of the City of Anaheim by providing a place within the City of Anaheim for presenting athletic events, pageants and other events of general public interest, including events sponsored by civic groups and by private commercial enterprises; and WHEREAS, the stadium facilities were expanded in 1956 by a cooperative venture between the City of Anaheim and the Anaheim Union High School District, with a contribution of $130,000000 from said District, to implement the expansion to accommodate larger groups of spectators and a major reason for such expansion was the use for high school football games and athletic events and in conjunction with such expansion a non- exclusive lease was entered into with the Anaheim Union High School District and said contribution of the Anaheim Union High School District was paid to the City under the terms of said lease and said lease is still in existence and provides for specific use of the facilities under said lease for high school football games and other events; and WHEREAS, the City Council of the City of Anaheim does find and determine that in order to best utilize the facilities of the La Palma Stadium in accordance with the best interests of the citizens of the City of Anaheim that a policy for such use should be established and that a fee schedule for use of the facilities be established to insure that the costs of main- tenance and operation of said facilities shall be borne by the users of said facilities; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1m That supervision, maintenance and scheduling of the La Palma Stadium facilities shall be and hereby are assigned to the Park and Recreation Department of the City of Anaheim, subject to the provisions of this resolution and any other directives of the City Council of the City of Anaheim and further subject to any lease or contractural relationship entered into by the City Council with any individuals or organizations. 20 All maintenance and use of the La Palma Stadium facilities shall be carried out so as to provide for proper turf maintenance and proper maintenance of facilities for cleanliness and appearance, and any scheduled event shall be subject to cancellation where the holding of such event at the scheduled time -1- would cause serious damage to the turf maintenance program. All future leases or contracts for use of the La Palma Stadium facilities shall contain such a cancellation provision as hereinabove set forth. 3. The priority of use of La Palma Stadium shall be subject to previously scheduled events and subject to any rights granted Anaheim Union High School District by the agreement made and entered into March 21, 1956, or any future agreement made and entered into by and between the City and the Anaheim Union High School District and subject as aforesaid, the pricrities of use shall be as follows a. City -sponsored events, (See Anaheim Union High School Contract.) Public ublic school events where the districts are substantially within the City of Anaheim, co Anaheim private school events, do Civic organizational events of local organizations, e. Public school events from districts outside City of Anaheim, f. Commercial events, g. Miscellaneous requests to be scheduled through the Park and Recreation Department and reviewed by the City Manager and City Council. All scheduling shall be made upon request of sponsoring agencies or groups and it shall be the responsibility of each agency or group desiring the use of the La Palma Stadium facilities to make its request a sufficient time in advance of its proposed use to allow ample time for the Park and Recreation Department to schedule such use. Time of request for use shall not establish any priority except between users in the same category as above set forth but schedules of use when confirmed by the Park and Recreation Department shall not be there- after altered without either the permission of the affected group or the approval of the City Council after a hearing thereon. 4. All users of the La Palma Stadium facilities shall furnish at their sole cost and expense, all ticket sellers, ticket takers, ushers, program sellers, announcers, public- address system operators, score- board operators, dressing -room attendants, and other operation personnel as may be required for the use of the stadium, 5. The following charges are charges to be paid to and Anaheim for use of the La except in the case of use School District where the existing lease hereby established as the collected by the City of Palma Stadium facilities by the Anaheim Union High charges are set forth in an ao Cost Schedule I shall be 10% of gross receipts or a minimum of $125.00 for daytime use or $350.00 for nighttime use whichever is greater unless in the case of City sponsored events the use is budgeted or otherwise authorized by the Council or Administrative directive or interdepartmental agreement. $250.00 or 10. of gross receipts use, whichever is greater. $500.00 or 10% of gross receipts use, whichever is greater. This cost schedule shall apply to use by public school events from districts outside the City of Anaheim, commercial events, and to miscellaneous events not otherwise determined to be under Cost Schedule I by the City Council. 6. In addition to charges specified above, the City of Anaheim will operate all concessions and retain profits therefrom unless otherwise specified by special agreement approved by the City Council. THE FOREGOING RESOLUTION is approved and signed by me this 22nd day of November, 1960. (SEAL) ST: This schedule shall apply to use by City sponsored events, public school events where the school dis- trict is substantially within the City of Anaheim, Anaheim private school events, civic organizational events of local organizations, and miscellaneous events not otherwise set forth when determined by the City Council to be subject to this schedule.
