1961-6794RESOLUTION NO. 6794 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING THE REQUEST OF MELVIN L. AND DONNA D. SCHARNWEBER FOR CONDITIONAL USE PERMIT NO. 98. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from Melvin L. Scharnweber and Donna D. Scharnweber, Perris, Cali- fornia, to construct a group of one story, semi- private, de luxe units or apartments on the following described property: The North half of the Southeast quarter of the Northeast quarter of the Northeast quarter of Section 27, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on January 16, 1961, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 158, Series 1960 -61, granting Conditional Use Permit No. 98 subject to the condi- tions therein set forth; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 21st day of February, 1961 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did con- tinue said hearing to a later date; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 98 should be denied; -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Conditional Use Permit No. 98 be, and the same is hereby disapproved, and that the request of Melvin L. Scharnweber and Donna D. Scharnweber, Perris, California, for a Conditional Use Permit to construct a group of one story, semi private, de luxe units or apartments on the property hereinabove described, be and the same is hereby denied.
