A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 6396
RELATING TO VARIANCE NO. 1009.
WHEREAS, the City Council did heretofore, to wit,
on September 16, 1958, upon application from Dr. Murray Walker,
adopt Resolution No. 4758 granting a conditional zoning
variance to construct and operate a rest home on the property
described in said resolution, subject to certain conditions
set forth therein; and
WHEREAS, the City Council did thereafter, on October 18,
1960, adopt Resolution No. 6396 amending Resolution No. 4758
granting said Variance No. 1009, by amending Condition No. 5
thereof to read as follows:
"5. That a 6 -foot masonry wall be constructed
in accordance with and at the location
shown on the sketch presented to the City
Council on October 18, 1960, and on file
with the City of Anaheim."
AND WHEREAS, the applicant, Dr. Murray Walker, has
requested a waiver of said Condition No. 5 inasmuch as he has
acquired the property on the south and east sides adjoining
the property on which said Variance No. 1009 was granted, for
future expansion of the rest home; and
WHEREAS, the City Council finds that said Condition
No. 5 of Resolution No. 6396 should be waived, upon condition
that a short -term agreement be entered into by the owner of
subject property with the City of Anaheim, providing for the
construction of the wall when required by the City of Anaheim..
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 6396 amending Condi-
tion No. 5 of Resolution No. 4758 granting Variance No. 1009
be, and the same is hereby, amended as follows:
That Condition No. 5 of Resolution No. 6396
be and the same is hereby waived, upon condi-
tion that the owner of the property on which
said variance is granted enter into a short-
term agreement with the City of Anaheim, ap-
proved by the City Attorney, which agreement
shall be placed of record in the Office of
the County Recorder of Orange County and shall
provide for the construction of said six (6)
foot wall when required by the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 20th day of June, 1961.
