1961-6982RESOLUTION NO. 6982 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEITSN GRANTING CONDITIONAL USE PERMIT NO. 118 TO OPERATE A TRAILER PARK ON PROPERTY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from Naomi L.Vanosse and Oliver E. Vanosse, Jr., 10582 Katella Avenue, Anaheim, California, for a Conditional Use Permit to operate a trailer park on the fol- lowing described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1. Lot 11 in Block 9 of the Golden State Tract, as shown on a Map recorded in Book 4, pages 66 and 67 of Miscellaneous Maps, records of Orange County, California. Parcel 2. Beginning at the Southeast corner of Lot 9 in Block K of the Kraemer Tract, according to a survey by Knox in 1882, and as shown on a Map recorded in Book 12, pages 87 and 88 of Mis- cellaneous Records of Los Angeles County, California; running thence Northerly along the Easterly boundary line of said Lot 9, 10 chains; thence Westerly at right angles 5 chains; thence Southerly parallel to the East line of said Lot 10 chains, more or less, to the Southerly boundary of said Lot; thence Easterly 5 chains to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on hay 15, 1961, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Comaission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 263 Series 1960 -61, denying Conditional Use Permit No. 118; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Per- mit, and said appeal was set for public hearing on June 13, 1961, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and -1- WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying said Conditional Use Permit be, and the same is, hereby disapproved, and that Conditional Use Permit No. 118 be, and the same is, hereby granted to NAOMI L. VANOSSE and OLIVER E. VANOSSE, JR., 10582 i<atella Avenue, Anaheim, California, permitting the operation of a trailer park on the property hereinabove described, subject to the following con- ditions: 1. That final plans for the development of sub- ject property shall be submitted to and approved by the City Council, and said plans shall con form to the standards as set forth in the proposed Trailer Park Ordinance on file in the office of the City Planning Commission; and that the Southerly line of subject property shall be developed in accordance with the contours established by the agreement between the State of California, Department of High- ways, and the City of Anaheim. 2. That the owners of subject property deed to the City of Anaheim a strip of land thirty -two (32) feet in width, from the center line of the street, along Anaheim Road for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, side- walks, street grading and paving, drainage facilities, or other appurtenant work be com- plied with as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer; and (b) that a bond in an amount and form satis- factory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements at the time subject property is developed, but, in any event, within a period of two (2) years from date hereof, or such further time as the City Council may grant. 4. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot on the present frontage for street lighting pur- poses, said amount to be paid at the time the building permit is issued. 5. That the owners of subject property deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as dete /mined and required by the Utilities Director of the City of Anaheim. 6. That the owners of subject roperty pay to the City of Anaheim the sum of per trailer space to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. The City Council hereby reserves such Conditional Use Permit for good cause owners, their heirs, successors or assigns Anaheim Municipal Code and regulations and herein.
