56R-3440 RESOLUTION NO. 3440 ",- A RESOLUTION OF THE CITY COUNCIL OF Till CITY OF ANAHEIM DENYING wITHOUT PREJUDICE VARIANCE NO. 578 ',vEEREAS, the City Planning Commission of the City 01 Anaheim did receive a petition from the owner and agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The SoutheasT corner of Broadway and Magnolia Avenues, and being a part of I'ract No. 25; AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on July 2, 1956, notices of which said public hearing were duly given, as required by law al~ the provisions of Section 9200.17 of the Anaheim Municipal Code; and ';fllliREAS, saia. City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence ann, reports offered at saia heari.ng, did adopt Resolution Nc. 230, Series 1955-56, recommending that Variance No. 578 be granted upon the conditions therein set forth; and :!~REAS, thereafter, within twenty (20) days from the cia.te of tne adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City PIEcnning Commission in grant in,;;' said variance and did set a publie hearing t."lere on to be held on the 14th day of August, 1956, at 7:00 Oeloc;: P. M., in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 01' the Anaheim Hunicipal Code; and w~REAS, at the time and place fixed for said nublic hearing, the City Council did duly hold and conduct such public hearing and did give all gersons interested therein an opportun- ity to be heard, and did continue said heEring to August 28th, 1956, at 7:00 o'clock P. M.; and ;;Hl:.;REAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reoorts offered at said hearings, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject oroperty. ,- 2. It appears that the subject property can be adequately developed and used under the present zone. -1- .--, .-' NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variance No. 578, requesting permission to erect a temporary sign at the southeast corner of Broadway and Magnolia Avenues, advertising the sale of houses and lots in Tnct No. 2440, be and the same is hereby, disapproved, and that Variance No. 578 be, and the same is hereby, denied without prejudice to the right of applicant to re-apply within six months if applicant can show good cause therefor.
