56R-3425 -~ RESOLUTION NO. 1425 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 602. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owner and the agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follo~lS : That portion of the NWi of the NEt of Section 17, T4S, RIOW, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, as said NEt is indicated on a map of Tract 647, recorded in Book 20, page 34, Miscellaneous I~ps, records of Orange County, California, described as follows: Beginning at a point on the North line of said Sec- tion East 340 feet thereon from the NW corner of the land described in Parcel 1 of the deed to the Greco Construction Corp. recorded October 6, 1955, in Book 3235, page 147 of Official Records; thence South 300.00 feet parallel with the West line of said Greco Construction Corp. land; thence East 120.80 feet more or less parallel with the North line of said Section to the West line of the land described in deed to Patrick G. O'Keefe and wife, recorded November 10, 1955 in Book 3278, page 385, Official Records; thence North 300.00 feet along the West line of said OIKeefe land to the North line of said Section; thence West 120.75 feet more or less to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on the 6th day of August, 1956, notices of which said public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 21, Series 1955-1956, re- commending to the City Council of the City of Anaheim that Variance No. 602 be granted upon the conditions stated in said Resolution; and - F' WHEREAS, the ~ity Oouncil does find that: 1. There are exceptional or extraordinary cir- cumstances or conditions applicable to the property involved or to the intended use of the property tr~t do not apply generally to the property or class of use in the same vicinity and zone. 2. The.t such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the Same vicinity and zone and denied to the property in question. -1- --- 3. That the granting of such variance will not be materially detrimental to the pub- lic welfare or injuriou~ to the property or improvements in such\vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affec t the comprehensive, general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to WILLIAM T. McMANUS, 9461 Vons Drive, Anaheim, California, for the use of said property for the following purpose: To erect a professional building for medical use; sub- ject to the following conditions: 1. That curbs, gutters and sidewalks be installed along Lincoln Avenue as required by the City Engineer. 2. That landscaping be provided in front of the building. 3. That said building be erected in accordance with plans presented to the City Council and on file with the City of Anaheim. 4. That the building set-back line shall be main- tained at a minimum of 75 feet from the center- line of Linooln Avenue. 5. That the owners of subject property shall dedi- cate to the City of Anaheim a right-of-way for street purposes as designated by the City Engi- neer. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or assigns to comply with the Ana- heim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
