56R-3422 ~~~-, /~ - RESOLUTION NO.-2422 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO;:586) WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owner and/or of certain real property situated in the-City of Anaheim, County of Orange, State of California, described as follows: . h Beginning at a point ~n t e center line of Broadway 748.)0 feet from its intersection withthe center line of Bond Street; thence N 150 201 JOn W, 140.00 feet to a point; thence N 740)6140" E, 120.86 feet to a point; thence S 150201)0" E, 84.01 feet to the beginning of a curve concave westerly having a radius of 15 feet; thence through a central angle of 89057'1011 and a length of 2).55 feet to a point; thence S 15020'30" E, 40.00 feet to a point in the center line of Broadway; thence S 74036140" W, 105.87 feet along said center line of Broadway to the point of beginning. Subject to an easement over the South 40.00 feet thereof for Street purposes. and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on July 2nd, 1956 ,notices of which said public hearings were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, invest- igation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 239 recommending to the City Council of the City of Anaheim that Variance No. 586 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the pro~erty in- volved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or in- jurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adverselYJaffect the comprehensive general zoning plan. That sidewalks be installed in front of the lots. f......... 2. That the owner of subject property pay into the Park and Recreation Site Fund the sum of $25 per lot. 3. That the owner of subject property file with the City of Anaheim and with the County of Orange a Record of Survey Map covering said lots. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Munici- pal Code unless otherwise specified herein.
