RESOLUTION NO. 3403
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (No. 575)

WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition from the property owner and/or
~nt of certain real property situated in the-City of
An eim, County of Orange, State of California, described as
follows:
The South 150 feet of the East 165 feet of the
Southeast Quarter of the Southeast quarter of the
Southwest Quarter of Section 7, in Townahip 4
South, Range 10 West, San Bernardino Base and
Meridian.
(Said property 18 located at the Northwest corner
of Lincoln Avenue and Gilbert Street.)
and
WdEREAS, the City Planning Commission did hold a public
hearing at the City Hall in the City of Anaheim upon said petition
on June 18, 1956 , notices of which said public hearings
were duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, invest-
igation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. 226 recommending to the City Council
of the City of Anaheim that Variance No. 575 be granted upon the
conditions stated in said resolution; and
1I/HEREAS, the Ci ty Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the pro~erty in-
volved or to the intended use of the property that
do not apply generally to the property or class of
use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or in-
Jurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not
adverselYJaffect the comprehensive general zoning plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to Arthur Hartelt , III N.Gilbert st.
Anaheim, California t'6-r t'he use of said oroperty for the
f61Yowing pUrposes: -
The erection of a service station upon the conditions
hereinafter set forth:

l. That the mmeI' ,y' owners of subject prope:. __ arrange with the state
Highway Department for the 10 feet required for the widening of the
~o~th side of Lincoln Avenue.
2.-That the owner or owners of subject property deed to the City of
Anaheim a strip of land 10 feet in depth along Gilbert street for
street widening purposes.
3 That curbs and gutters be installed on both Lincoln Ave. and
Gilbert St. in accordance with the requirements of the City Engineer.

The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner
or their heirs, successors or assigns to comply with the Anaheim
!1unicipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim Munici.
