1961-7301WHEREAS, the City Council of the City of Anaheim
by Resolution No. 5409 did establish rates for general water
service and connections, and did fix charges for the instal-
lation of water mains for water furnished consumers and for
all services rendered in connection therewith; and
WHEREAS, at the time of the adoption of said Resom
lution No. 5L1..09 all consumers of water from the City of
Anaheim were original consumers from such system to which
service had been extended at their special instance and
request and all rates were based upon such circumstance; and
WHEREAS, the City of Anaheim is presently contem-
plating purchase of a portion of the Pacific Water Company
system in an unincorporated area which is contiguous to the
Anaheim water system and has presently negotiated the purchase
of part of such portion subject to the approval of the Public
Utilities Commission of the State of California; and
WHEREAS, Resolution No. 54.09 does not establish a
rate for this type of service; and
WHEREAS, it is deemed desirable by the City Council
of the City of Anaheim that a special rate be set up for this
area to maintain in effect the same rate charged by the
Pacific Water Company for this area pending possible annexa.m
tion to the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that paragraph 7 of Resolution No. 5409
be amended to read as follows:
"7. RATES OUTSIDE CITY LIMITS.
"(a) Applicable to all consumers of water outside
the City limits of the City of Anaheim from City -owned and
maintained water mains except as provided in paragraph (b)
hereof:

"Provided, however, that in territory capable of
being annexed to the City of Anaheim where proceedings have been

commenced in good faith for the annexation of said territory to
the City of Anaheim and where a petition for annexation is
filed with the City Clerk for the City of Anaheim signed by
a majority of the registered voters registered and residing
in said territory proposed to be annexed to the City, and by
the owners of 51% of the value of the territory proposed to
be annexed, as shown by the last equalized assessment role,
and said proceedings are deligently advanced, then, in that
event, the water rates in such territory outside the City
limits, shall be the same as the rates within the City limits,
for a period of not to exceed six (6) months. If siad pro-
ceedings are not diligently prosecuted to completion within
said period of time above mentioned, or such further time as
the City Council may grant, the rates for the sale and delivery
of water outside the City of Anaheim shall be charged to the
property owners within said territory.
"(b) The rates applicable to all consumers of water
from City -owned and maintained water mains outside the City
limits of the City of Anaheim where the water mains have been
purchased from a domestic water company which previously
serviced the consumers, shall be the same rates as were
previously paid the private domestic water company for a
period of two years after the consummation of the purchase or,
until the territory wherein the service is rendered is annexed
to and becomes a part of the City of Anaheim; and, after said
two-year period, if the territory has not become a part of the
City of Anaheim, paragraph (a) above shall apply to such con*-
sumers. The applicahle rates for such service as applied to
each particular purchase contract shall be adopted as amend-
ments to this resolution and shall be numbered as subparagraphs
hereto.

BE IT FURTHER RESOLVED that, except as herein
amended, all other provisions of Resolution No. 5409 are to
remain in full force and effect.
THE FOREGOING RESOLUTION is approved and signed
