56R-3396 -, ,- RESOLUTION NO. 1196 A RESOLUTION OF THE CITY COUNCIL OF THE aITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2,OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACOOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the Oity of Anaheim has heretofore duly passed and adopted a resolution deolaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and plaoe for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct two public hearings to consider suoh proposed ohang~ of zone or zones and did reoeive evidence and reports from persons interested thereinj and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of faot,s and I declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 24th day bf July , 195-6--, as the time and the Oouncil Chambers in the Ci ty Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said pUblic hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon oonsider the reoommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in whioh it 1s now situated to a different zone as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will inorease the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City of Anaheim that all of the property and area situated in the Oity of Anaheim, County of Orange, State of California, desoribed as follows, to wit: "- Parcell: The West 133 feet of the North 165 feet of' the Northwest quarter (NW~;) of Section 18, Township 4 South, Range 10 West, SBB&M. Parcel 2: The East 35 feet of' the West 168 feet of the North 165 feet of the Northwest quarter (NW*) of Section 18, Township 4 South, Range 10 West, SBB&M. EXCEPTING THEREFROM an undivided 3/5th interest in the South 15 feet of the North 165 feet of the East 27 feet of the West 160 teet of the Northwest quarter of Section 18. -1- ;Z-s-..)-~-c -y'y ~ (Said property is loc&ted at the Southeast corner of Lincoln and Magnolia Avenues.) be changed from R-A, Residential - Agricultural Zone, to C-l, Neighborhood Commercial Zone; Subjedt to the following conditions: 1. That arrangements be made "dth the state Highway Department for the land necessary for the widening of Lincoln Avenue. 2. That the owners of subject property deed to the City of Anaheim a strip of land 20 feet in depth along the East side of Magnolia Avenue for street widening purposes. 3. That curbs, gutters and sidewalks be installedpnLincoln and Magnolia Avenues as required by the City of Anaheim and as designated by the City Engineer. 4. That appropriate C-l deed restrictions be placed of record by the owners of subject property as required by the City of Anaheim and approved by the City Attorney. BE IT FURTHER RESOLVED that the Oity Attorney be, and he is hereby authorized and direoted to prepare and submit to the 01ty Oounoil an amendment to Article IX, Chapter 2 of the Anaheim Muni- cipal Oode to amend said Anaheim Municipal Oode to aocomplish the obJeot herein found and determined to be neoessary and proper.
