56R-3393 - RESOLUTION NO. 1191 A RESOLUTION OF THE CITY COUNCIL OF THE OITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2,01 THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACOOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the Oity of Anaheim has heretofore duly passed and adopted a resolution deolaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and plaoe for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did dUly hold and conduct two public hearings to consider such proposed ohange of zone or zones and did receive evidence and reports from persons ' interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of fact,s and I declare its opinions and reasons for recommending an amendment to said Article IX, Ohapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter mentioned and describedj and WHEREAS, upon receipt of the report and recommendation of the Oity Planning Commission, the City Council did thereupon fix the 24th day of .1111 y , 19.5-6..-.., as the tip1e and the Oouncil Chambers in the City Hall of the City of Anaheim as the place for a pUblic hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjOining zones. ~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the Oity of Anaheim, County of Orange, State of California, desoribed as follows, to wit: The East half of the Northwest quarter of the North- west quartel' 0:' tne Northwest quarter of' Section 16, T. 4 S. SBB~1, in the Rancho San Juan Cajon de Santa Ana . . .., , saw. lana. being further descri1)ed as that Dortion of the East half of Lot 4 of Helen ano, Lynch's Acidition to Anaheim, as shovm on a map recorcied in Book 1.)-42, p8.ge 158 of Deeds, in the office (I' the County Recorder of Orange County, except: beginning at a point in the North line of said Section said point being N. 890 03' 42" E., 330.08 feet from the No~thwest corner of said Section: thence N. 890 08' 42" E., along said -1- ?--s-s-.s'C, y'r -' North line, 330.07 feet; thence S. 000 2Lp SOil E., 307.0J feet; thence S 870 35' 0011 W., JJO.07 feet; thence N 000 26' 1511 W., 307.03 feet to the point of beginning be changed from R-A Residential Agricultural Zone to R-3 - 11ULTIPLE-FAIHLY-RESIDENTIAL ZONE, upon the following condi tions: 1. The development of a Master Plan of the complete area between Euclid Avenue and Loara Street. 2. That arrangements be me.de with the state Highway Department for that pOrtion of the frontage on Lincoln Avenue required for street widening purposes. 3. That appropriate R-J Deed Restrictions be placed of record by the owner of subject property as required by the City of Anaheim and approved by the City Attorney. BE IT FURTHER RESOLVED that the Oity Attorney be, and he is h.reby authorized and direoted to prepare a~ submit to the Oity Oouncil an amendment to Article IX, Chapter 2 of the Anaheim Xunl- elpal Oode to amend said Anaheim Municipal Code to aocomplish the $bject herein found and determined to be necessary and proper.
