56R-3392 ,- -.".- ~ RESOLUTION NO.-3~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 573) WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owner__ and/or A~nt of certain real property situated in the City of An eim, County of Orange, State of California, described as follows: Lot nine (9) and the easterly fifteen (15) feet of Lot eight (8) in Block IlAIf of the Lorelei Tract, as per map thereof recorded in Book 29, page 24 of Miscellaneous Records of Los Angeles County, California. (Said property is looated at 916 East Center Street, Anaheim, California.) and WHEREAS, the City Planning Commission did hold a publio hearing at the City Hall in the City of Anaheim upon said petition on June 18. 1956 , notices of which said public hearings were duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Municipal Code; and \'lHEREAS, said Commission, after due inspection, invest- igation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 224 recommending to the City Counoil of the City of Anaheim that Variance No. 573 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exoeptional or extraordinary circum- stances or conditions applicable to the property in- volved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That suoh a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vioinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or in- jurious to the property or imp~ovements in such Vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely}affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning varianoe be, and the same is hereby granted toBiED C. FISCHLE, 730 Wes~twood P~lace, Ana~eim, California for the use of said proporty for the folloWing purposes: To use the dwelling looated on the hereinabove desoribed property for a real estate offioe, and to install one sign only, size 4 ft. by lO ft., subjeot to the following oondition: -1- That imnroved off street parking be provided at the rear of the prope~ty for a minimum of three cars. - The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Munici- pal Code unless otherwise specified herein.
