1961-7277RESOLUTION NO. 7277 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING Ti-LT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THEā€¢BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of, the City of Anaheim did hold a public hearing in Reclassification Proceed= ings No. 61 -62 -15 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from Arsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resoiu tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that ce Lain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of she City Plan- ning Commission, the City Council did fix the 1pth day of October 19 61 as the time, and the City Council 1hem- bers in the City Hein the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented. at 5a.id public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61 -62 -15 Lots 8, 9, 10 and 11 of Tract No. 713, in the city of Anaheim, as shown on a map thereof recorded in book 22, page 10, Miscellaneous Maps, records of said Orange County; be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the following zone o7° zones C -1, NEIGHBORHOOD ODMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit No. 1," on file with the City of Anaheim, with the exceptions as noted on said exhibit. 2. That parking area shall be provided in accordance with the requirements of the Anaheim Municipal Code, the layout and dimensions of the parking area to conform to the approved open -air parking dimen- sions adopted by the City Planning Commission and on file in the Planning Department. 3. That a 6 -foot masonry wall shall be constructed along the west side of subject property, said wall to be constructed prior to final inspection of the buildings to be erected on subject property. (a) That a 6 -foot masonry wall shall be con- structed along the south side of subject property; and (b) that a bond in an amount and form satis- factory to the City of Anaheim shall be posted with the City to guarantee the construction of said wall within a period of two years from date hereof, or such further time as the City Council may grant. 5. That a 6 -foot landscaped strip shall be provided, and the landscaping maintained, parallel to and abutting the planned highway right of way lines of Knott Avenue and Savanna Street, the plans for said landscaping to be submitted to and ap- proved by the Superintendent of Parkway -2- Maintenance of the City of Anaheim, and said landscaping to be installed prior to final inspection of the buildings to be erected on subject property. 6. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street along Knott Avenue, for street widening pur- poses, and shall deed to the City of Anaheim a strip of land 30 feet in width from the center line of the street along Savanna Street, for street widening purposes. 7. (a) That all engineering requirement's of the City of Anaheim, along .Knott Avenue and Savanna Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accord- ance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satis- factory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 8. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along'Knot't Avenue and Savanna Street, for street lighting purposes. 9. That Conditions Nos. L(b), 6, 7(b) and 8, above mentioned shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper..
