1961-7218RESOLUTION NO. 7218 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TiiT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of. the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No., 61 -62 -18 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p :::sons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that cer- tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Flan= ning Commission, the City Counci.t did fix the 26th day of September 19 61 as the time, and the 7177 Council ham- bers in the City Hain the City of Anaheim as they place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it Is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at Said public hearing before the Planning Commission, its repot of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council.of the City of Anaheim that T:le 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61 -62 -18 Lot 106 of Tract No. 2903, as shown on a Map recorded in Book 99, pages 21, 22 and 23 of Miscellaneous Maps, records of Orange County, California; be excluded from the R -1, ONE- FAMILY RESIDENTIAL, ZONE, and incorporated in the following zone oi zorne:; C -1, NEIGHBORHOOD- OEMERCIAL, ZONE upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits 1 and 2" on file with the City of Anaheim, and by reference made a part hereof. 2. That only one unlighted sign shall be in- stalled on subject property, as indicated on Exhibit "A" on file with the City of Anaheim, and that said sign shall not exceed 4 feet in width and 6.3 feet in height. 3. That the existing residential character of the front portion of subject property shall be substantially maintained, with the ex- ception that sidewalks shall be installed on Katella Avenue as provided in Condition No. 4 hereof. 4. That sidewalks shall be installed along Katella. Avenue as required by the City En- gineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That the owner of subject property shall place of record City of Anaheim C -I Deed Restrictions approved by the City Attorney, which restrictions shall limit the uses of subject property to business and professional offices only. 6. (a) That a 6 -foot masonry wall shall be con- structed along the north boundary line of subject property, said wall to conform in color to the -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper. me this 26th day of September 19 61 ATTEST: existing wall; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said wall, and the installation of the sidewalks men- tioned in Condition No. L hereof. 7. That Conditions Nos. 5 and 6 (b),above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: None. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said Resolution No. 7218 on the 26th day of September, 1961.
