A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEHI ACCEPTDJG SEALED PROPOSAL AND
AWARDING CONTI{ACT TO THE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING TO THE CITY OF
ANAHEIM OF REINFORCED CONCRETE STEEL CYLINDER
PIPE AND FITTINGS. WORK ORDER NO. 1424.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to
wit, the Anaheim Bulletin, on the 28th day of June and the 5th
day of JUly, 1956, a notice inviting sealed proposals for the
furnishing to the City of Anaheim, in ap~)roximate quanti ties,
of the following reinforced concrete cylinder pipe and fittings,
including rubber gaskets for instellation:

~. AND WHEREAS, said notice did provide that said pipe
and fittings shall be in aocordance with, conform to, and comply
with II Interim Federal Specifica tionll. Pipe: Pressure, reinforced,
concrete, pretensioned reinforcement (steel cylinder type) _
No. SS-P-00)81 (GSA-FSS) issued April 2, 195). and modified by
the following: Pipe shall be Class 150 for 150 pounds maximum
water working pressure; and
WHEREAS, such notice inviting sealed proposals for said
reinforced concrete steel cylinder pipe and fittings, including
rubber gaskets for installation. did provide that said sealed
proposals would be received by the City Council of the City of
Anaheim at the Office of the City Clerk of said City up to the
hour of 7:00 o'clock P.M. on Tuesday, the lOth day of July, 1956
for the furnishing to the City of Anaheim of said pipe, fittings
and gaskets; and
WHEREAS, the City Clerk of the City of Anaheim did re-
oeive sealed proposals prior to 7:00 o'clook P.M., Tuesday. the
lOth day of July, 1956, for the furnishing of said reinforoed
ooncrete steel cylinder pipe and fittings, including rubber
gaskets for installation, from the following persons, firms or
oorporations:

AND h~EREAS, the City Council did thereupon submit
all bids received to the City Engineer for tabulation and report
to the City Council, and said City Engineer having tabulated
said bids and having submitted his report, the City Council does
find that the sealed nrooosal of Al.fERI CAN PIPE AND CONSTRUCTION
COMPANY, P. O. BOX )428,.TERMINAL ANNEX, LOS ANGELES 54, CALIF-
ORNIA, is the lowest responsible bid for the furnishing of rein-
forced concrete steel cylinder pipe and fittings including rubber
gaskets for installation, as specified in the notioe inviting
sealed proposals and in accordance with the specifications set
forth in said notice inviting sealed proposals, and that said
proDosal of American Pipe and Construction Co., should be accepted
and a contract awarded to said company for furnishing the pipe,
fittings and gaskets required by the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said pro~Josal submi ttecl by the American
Pipe and Construction Co. for the furnishing of reinforced con-
crete steel cylinder pipe and fittings, including rubber gaskets
for installation, as specified in the notice inviting sealed pro-
posals therefor, and in accordance with the speoifications set
forth in said notice inviting sealed proposals, be, and the same
is hereby accepted, and that a contract for the furnishing of said
pipe, fittings and gaskets be, and the same is hereby, awarded to
said American Pipe and Construction Co.; and
BE IT FURTHER RESOLVED that the award of a oontract to
said American Pipe and Construction Co. is declared to be for the
approximate quantities set forth in the notice inviting sealed
proposals; and
BE IT FURTHER RESOLVED that said American Pipe and
Construction Co. be, and it is hereby, required to execute a
contract for the furnishing of said pipe, fittings and gaskets,
in form satisfactory to the City of Anaheim and upon the terms
and conditions specified in the notice inviting sealed proposals,
the proposal submitted by it, this resolution, and in accordance
with the specifications for reinforced concrete steel oylinder
pipe and fittings as set forth in said notice inviting sealed
proposals, in all required sizes and lengths, at the prices as

AND BE IT ;'URTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, aocepted
and said contr8ct awarded for the above specified reinforced oon-
crete steel cylind.er pipe and fittings, including rubber gaskets
for installation, F.O.B. mill or point of shipment, with freight
allowed to trenchside, Anaheim, California, said pipe, fittings
and gaskets to be dellvered as follows:
The design and layout drawings to be presented within
two weeks from receipt of plans and. profile, and deliveries of
said pipe and fittings to be made within ninety (90) days after
approval of layout drawings and receipt of order; and
BE IT FURTHER RESOLVED that said contract shall contain
a provision that should said American Pipe and Construction Co.
fail or neglect to furnish said. concrete steel cylinder pipe,
gaskets and/or fi ttin8'S in accord.ance with said specifications
end the nroposa.l submitted by it and accepted by the City of
Anaheim within the time herein specified, it shall, in addition

to any other penalties provided in the contract documents, be
liable to the City of Anaheim for all 10s8 or damage that the
latter may suffer on account thereof.
