INCLUDIHG PO~]I;R, FU;!;L AND ';'lATEh, AND PERF03.iHNG ALL '.laID: 18CEE~ SA:=rl TO CONSTRUCT AND COH?LI:T:: ?~ FOLLO:lING PUBLIC IHPROVEI.lENT: THE IMPROVEMENT OF THE INTERSECTI01L~A P&11A-_Ay::e~jJE:_ [l.l'lP_j::AST SJ.'REj;TS, 10B NO. llL___._______._____.~____________ ifHEiGAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circu- lation, printed, published and oirculated in the City of Anaheim, to wit: The Anaheim Bulletin, on the J.2 &: 26days of June ,1956 ,a notice~nviting sealed proposals for furniahlnG the roYlowing: All plant, labor, servioes, materials and equipment, and all utilities and transportation, inoluding power, fuel and water, and performing all work necessary to construct and oomplete, in a good and workmanlike manner, in strict aocord- ance with the plans and speoifications on file in the office of the City Clerk of the City of Anaheim, the improvement of the intersection at La Palma Avenue and East Street by construction of culverts, excavation, paving with plant-mix, adjusting existing manholes to grade, construction of concrete curbs and gutters, oonstruction of storm drains, including all ~quipme9t, castings, structures and excavation, construction of plant-mix berms, and appurtenant work, as indicated on the plans, Job. No. 117. in accordance with the designs, plans, profiles and spec- ifications of said publio improvement on file in the Office of the City Clerk of the City of Anaheim; and ...,-,.. :W~nEAS, said notice inviting sealed proposals for said public improvement did provide that sealed pro- posals would be received by the City Council of the City of Anaheim at the Office of the City Clerk of the City of Anahe 1m up to the hour of 7: 00 0 t clOt1k P. :~. on the iQ~ day of JuU-' 1956 for the furnishing 0 a plant, 1aDor,--8e~viceS7 materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and worIDuanlike manner, the public improvement hereinabove more particularly mentioned and desoribed and whioh notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had asoer- tained the prevailing rate of wages in the locality in whioh this type of labor iB to be performed for eaoh craft or type Of workman or mechanic needed to execute the contract and did set forth the prevailing hourly wage Beale so ascertained; and WHEREAS, the City Council of the City of Anahejm did reoeive the following sealed proposals prior to 7:0C o I clock P.M. on the 10th day of JU1?; ,195,",-, in response to the notice aforesaid Invi~~ng sealed pl~- posals, to wit: , -.L- NAME - UNIT BID PRICE TOTAL PRICE f~ Sully-Miller Contracting Company R. Noble Company Cox Brothers Construction Company $13,268.90 14,717.50 17,118.36 WHEREAS, the City to the Oi ty En/o1:ineer _ examination, tabulation and report to the Oi",Y En~neer late sai sealed proposals and did report result of his examination and tabulation; Council did thereupon refer said bids for City Council, and said did examine and tabu- to the Council the and WHEREAS, the City Council finds that the sealed proposal subll1i tted by SULLY-MILLF.R CONTRACTING COMPANY 2 is e lowest respons b e proposa subm tte or he urnishing 0 all plant, labor, services, materials and equipment, all utilities and transportation, inoluding power, fuel and water and performing all work necessary to construct and complete in a good and workman- like manner in strict aocordance with the speoifications, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim of the publio improvement hereinabove mentioned and described, together with the appurtenanoes thereto, and as speoified in the notioe inviting sealed proposals, and that said proposal of said above named bidder should be aocepted and a oon- tract awarded to said bidder in accordance therewith; and WHEREAS, the City Counoil finds that the above mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or oorporation submitting said proposal is a responsible person, firm or oorporation and that the proposal sub- mitted is the best suited and fitted for the public improvement to be oonstruoted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the sealed proposal submitted by SULLY-MILLER CONTRACTING COMPANY - for the furnishing 01' all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and pe rforming all work neoessary to oonstruot and com- plete in a good and workmanlike manner, in striot accordance with the speoifioations, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim and the notioe in- -2- - viting sealed proposals, the public Horks and lL1provements herein- above more particularly mentioned and described, together \lith the appurtenances thereto, be, and the same is hereby, accepteQ, and that a contract for th.e construction and completion of said public improvement be, and the same is hereby, awarded to the said above named b iddor . AND BE IT FUrtTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth shall be, and they are hereby required to e;~ecute a contract in the re- quired form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submi tted by said successful bic1der or bidc1ers E~nd in accordance with the plans and specifications for said public improvement hereinabove described and in accordance with the terms, conditions and provisions of this resolution, and that said successful bid~er or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100%) of the contract price for all labor, materials and equipment to be furnished and performed as set forth in the sealed proposals submitted by said bidder for the construction of said public im- provement together with the appurtenances thereto or such portion thereof as is covered by said contract as security for the faith- ful performance of said contract and a separate surety bond in an amount equal to one hundred per cent (lOO;~) of the construction cost of said public improvement covered by said contract as security for the payment of all persons performing labor and furn- ishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim public liability, property damage, compensation, and other insur- ance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals and subject to the approval of the City Attorney as to form ana sufficiency.
