56R-3368 RESOLUT IOU NO. 3)68_- ,,- A r~SOLUTION OF THE CITY OOUNGIL OF TilE CITY OF ANAEEIi.f ACCE?TING A SEALED PROPOSAL AND A.lk1.DING A COITaAOT TO THZ Lm;ZST R::S:?CNSI3I.Z BID~Ea FOR TI3 FUR~I3HING OF ALL PLAlJT, LA30R, SERVICES, j.IATERIALS AND EQ.UIPI-fEHT Ai'D ALL UTILIl'IES AND TRANSPORTAJ:'ION, INCLUDIiJG PO;JI:l1., FU;:;::L AND '~'lATEh, AND PERFO?JHNG ALL 'JORK NECES- SA:i.Y TO CONSTRUCT AND OGti?LBT;:; ?~ FOLLO;TING PUBLIC mpaOVEI.lENT: THE IMPROVEMENT OF WEST STREET FROM LA PAL!{A-A~~ DRIVE, .JOB NO~ 114..==::==_======~==~=:==~= mm:rcAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circu- lation, printed, published and oiroulated in the City of Anaheim, to wit: The Anaheim Bulletin, on thel~ & 26 days Ql June ~__ _~ _, 195 6 , a notice inviting sealed proposals for furnisninG the fOllowing: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work neoessary to oonstruct and complete, in a good and workmanlike manner, in strict aocord- ance with the plans and specifioations on file in the office of the City Clerk of the City of Anaheim, the improvement of West Street from La Palma Avenue to Romneya Drive by excavation paying with plant-mix surfaoing, construotion of concrete curbs and gutters, sidewalks and cross-gutters, remodeling of concrete irrigation line, and appurtenant work as indicated on the plans, Job No. 114. ~ in accordance with the designs, plans, profiles and spec- ifioations of said ~ublic improvement on file in the Offioe of the City Clel'k of the City of Anaheim; and ;W~REAS, said notice inviting sealed proposals for said public improvement did provide that sealed pro- posals would be received by the City Council of the City of Anaheim at the Office of the City Clerk of the City of Anahe im up to the hour of 7: 00 0 I clock P. :~. on the lOth day of JulL-' 1956 for the furnishing of an plant, ~abor,-se~vices, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and worbnanlike manner, the publio improvement hereinabove more particularly mentioned and described and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascer- tained the prevailing rate of wages in the looality in which this type of labor is to be performed for each craft or type of workman or meohanic needed to execute the contract and did set forth the prevailing hourly WQg€ scale so ascertained; and WHEREAS, the City Counoil of the Oi ty of Anahe1m did receive the following sealed proposals prior to 7:0C o'clock P.M. on the tpU1day of Jifly 1195L, in response to the no ce aforesaid inviting sealed pro- posals, to wit: NAME - UNIT BID PRICE TOTAL PRICE Sully-Miller Contracting Company R. P.O.Box 4 2 Oran e California is he lowest respons e proposa subm tted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to construct and complete in a good and workman- like manner in strict accordanoe with the speoifioations, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim of the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notioe inviting sealed proposals, and that said proposal of said above named bidder should be aocepted and a oon- traot awarded to said bidder in accordance therewith; and WHEREAS, the City Counoil finds that the above mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or oorporation and that the proposal sub- mitted is the best suited and fitted for the public improvement to be oonstruoted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the sealed proposal submitted by SULLY-MILLER CONTRACTING COMPANY i-'- for the furnishing or all plant, labor, servioes, materials and equipment, all utilities and transportation, including power, fuel and water and pe rforming all work neoessary to oonstruot and oom- plete in a good and workmanlike manner, in striot accordanoe with the speoifications, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim and the notioe in- -2- '-'__'_=,-.0,. ,-,'_"__.1 - ,-- viting sealed proposals, the public works and improvements herein- above more particularly mentioned and described, together Ili th the appurtenances thereto,be, and the same is hereby, accepted, and t~~t a contract for the construction and completion of said publiC imDrovement be, and the same is hereby, awarded to the said above named b iddor . AND BE IT FURJ:'HER RESOLVED that the successful bidder or bidders ilpon eaoh contract awarded as hereinabove set forth shall be, and they are hereby required to e:::eoute a contract in the rc- quired form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidc1ers tend in accordance Vlith the plans and specifications for said publiC improvement hereinabove described and in accordance with the terms, conditions and provisions of this resolution, and that said suocessful bidcer or bidders to whom each contraot is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100%) of the oontract prioe for all labor, materials and equipment to be furnished and performed as set forth in the sealed proposals submitted by said bidder for the oonstruction of said public im- provement together with the appurtenances thereto or such portion thereof as is covered by said contraot as security for the faith- ful performance of said contract and a separate surety bond in an amount equal to one hundred per cent (lOO/~) of the construction cost of said publio improvement covered by said contract as secu.ri ty for the payment of all persons Ilerformlng labor and furn- ishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim public liability, property damage, compensation, and other insur- ance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals and subject to the approval of the City Attorney as to form and suffiCiency.
