1961-7162RESOLUTION NO. 7162 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 29th day of August 19 61 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -4 The South 70 feet of the North 160 feet, measured from the North line of Lot 20 of Helen and Lynch's Subdivision, as shown on a Map of Survey, recorded in Book 6, Page 45, Record of Surveys in the office of the County Recorder of Orange County, California, of the West 250 feet, measured from the center line of Euclid Avenue, as established by the County Surveyor of said County, and shown in the County Surveyor's Transit Book 108, Page 15 of Lot 20 of Helen and Lynch's Subdivision, as shown on a Map recorded in Book 442, Page 158 of Deeds, in the office of the County Recorder of Los Angeles County, California. EXCEPT the East 80 feet thereof; be excluded from the R -A RFSTfENTTAT._AGRT ILTTTRAT, ZONE, and incorporated in the following zone or zones: C -1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following condi- tions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue, for street widening purposes. 2. j(a) That all engineering requirements of the City of Anaheim, along Euclid Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering require- ments. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Euclid Avenue, for street lighting purposes. 4. That a 6 -foot building setback area shall be established abutting the planned highway right of way line; that said setback area, and the parkway portion of the dedicated streets, shall be landscaped and said landscaping maintained; and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. That the owners of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the use of subject property to business and professional offices only. 6. That only one sign shall be installed on subject property, the maximum size of which shall be 3 square feet, and that such sign shall be installed parallel with, and shall be attached to the face of the proposed building. 7. (a) That a 6 -foot masonry wall, with no openings therein, shall be constructed along the south and east boundaries of subject property; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said wall. 8. That parking spaces shall be provided in accordance with the requirements of the Anaheim Municipal Code. 9. That subject property shall be developed substantially in accordance with Exhibit "A" on file with the City of Anaheim, and by reference made a part hereof. 10. That the owners of subject property shall dedicate to the City of Anaheim the access rights to the public alley abutting subject property. 11. That Conditions Nos. 1, 2(b), 3, 5, 7(b) and 10 above mentioned, shall be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant.
