1961-7132RESOLUTION NO. 7132 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 60 -61 -105 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 22nd day of August 19 61 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 60 -61 -105 Those parcels of land being a portion of the Southwest quarter of Section 9, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, Records of Orange County, California, described as follows: PARCEL 1: That portion of the Southwest quarter of the Southwest quarter of said Southwest quarter, described as follows: Commencing at the Southwest corner of said Section 9; thence North 89 14° 25" East along the South line of said Section, 85000 feet; thence North 0 45 35" West 30000 feet; thence North 16 43' 13" East 13005 feet to the Northwest corner of the land described in Parcel 2 in the deed to the State of California recorded in Book 3414, Page 69 of Official Records, and the true point of beginning of the boundary of the land herein described; thence North 87 35' 50" East, along the Northerly boundary of said land, 146000 feet; thence North 0 45' 35" West 201,38 feet to the Southerly line of the land described in Parcel 1 of said deed to the State of California; thence Southwesterly, along said Southerly line South 65 16' 49" West 83,85 feet and South 46 15' 17 West 29061 feet to the most Southerly corner thereof; thence, leaving said Southerly line, South 16 43' 13" West 158065 feet to the true point of beginning. PARCEL 2: (a) That portion of the Southwest quarter of the Southwest quarter of said Southwest quarter, described as follows: Commencing at the Southwest corner of said Southwest quarter; thence North 89 41' 25" East along the South line of said Section, a distance of 85000 feet; thence North 0 45' 35" West 30000 feet; thence North 16' 43' 13" East 13005 feet to the Northwest corner of land described in Parcel 2 in deed to the State of California recorded in Book 3414, Page 69 of Official Records; thence North 87 35' 50" East 246.00 feet along the Northerly line of said Parcel 2 to the Southeast corner of land described in a deed to Rayco Warehouse Corp., recorded June 29, 1961 in Book 5769, Page 570 of Official Records, said point being the true point of -2- beginning; thence continuing North 87 35' 50" East along said Northerly line a distance of 65000 feet; thence North 0 45 35" West to the Southerly line of land described as Parcel 1 in said deed to the State of California; thence South 75 20' 37" West 66093 feet along said Southerly line to the Northeast corner of said land of Rayco Warehouse Corp.; thence South 0 45' 35" East to the true point of beginning. EXCEPTING THEREFROM the East 20 feet for Loara Road and the South 30 feet for Lincoln Avenue. ALSO EXCEPTING THEREFROM the North 36.58 feet of the South 66.58 feet as granted to the State of California by deed recorded December 3, 1956 in Book 3729, Page 588 of Official Records. be changed from the M -1, LIGHT MANUFACTURING ZONE and P -L, PARKING LANDSCAPING ZONE to the following zones, upon the conditions hereinafter set forth: That Parcels Nos. 1, 2, 5, 6 and 7 above described be changed to C -3, HEAVY- COMMERCIAL ZONE; and That Parcels Nos. 3 and 4 be changed to M -1, LIGHT- MANUFACTURING ZONE, upon the following conditions: 1. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, where said im- provements do not presently exist or for which provision has not previously been made by the City Planning Commission or the City Council. 2. That bonds in amounts and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements; and that said bonds shall provide for installation of said engineer- ing requirements within a period of two years from date hereof, if such period is requested by the own- ers or occupants of subject parcels of property. 3. That landscaping shall be provided and maintained in the parkway portions of the dedicated streets where said parkways are not fully cemented in, and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. 4. That a front yard building setback line shall be established along said Parcels Nos. 1, 2, 3, 4, 5, 6 and 7 extending from the face of the Rayco Beat Cover Company building to and along the south line of the brake pit of the Nation -Wide Safety Brake Center. BE IT FURTHER RESOLVED That the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
