1961-7074RESOLUTION NO. 7074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR AN EASEMENT FOR ROAD AND PUBLIC UTILITY PURPOSES. WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit: An easement for road and public utility purposes; and WHEREAS, the owner of said property has offered to sell 2nd convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of AMERICAN LACE PAPER COMPANY, a corporation organized under the laws of the State of Wisconsin, to sell to the City of Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for an easement for road and public utility purposes, and more particularly described as follows: An easement for road and public utility purposes over, under and across those parcels of land described as follows: PARCEL ONE: The Northerly 45.00 feet and the Westerly 45.00 feet of that portion of the Northwest quarter of the Southeast quarter of Section 23, being a portion of Lot 41 in Township L. South, Range 10 West in the Rancho San Juan Cajon de Santa Ana as shown on a Map recorded in Book 2, Pages 256 and 257 of Patents of Los Angeles County, California, lying Southwesterly of the Southwesterly right of way line of the Atchison, Topeka and Santa Fe Railway Company, and Northerly of the Northerly right of way line of the Tustin Branch of the Southern Pacific Company. EXCEPTING THEREFROM the Northeasterly 5.0 feet of the above described parcel of land, measured radially from said Southwesterly right of way line of the Atchison, Topeka and Santa Fe Railway Company. ALSO EXCEPTING THEREFROM the Southerly 270.00 feet of the above described parcel of land, measured at right angles from said Northerly right of way line of the Tustin Branch of the Southern Pacific Company. PARCEL TWO: Beginning at the Northwest corner of the Northwest quarter of the Southeast quarter of Section 23, Township L. South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 2, Pages 256 and 257 of Patents of Los Angeles County, California; thence Easterly along the North line of the Northwest quarter of the Southeast quarter of said Section 23, South 89 50' 15" East, a distance of 60.17 feet; thence South 0 09' 45" West a distance of 45. feet to a point in a line parallel with and 45.00 feet Southerly of the North line of the Northwest quarter of the Southeast quarter of said Section 23, said point also being the beginning of a curve concave Southeasterly and having a radius of 15.00 feet; thence Westerly and Southerly along said curve through a central angle of 90° 09' 45" an arc distance of 23.60 feet to a point in a line parallel with and 45.00 feet Easterly of the West line of the Northwest quarter of the Southeast quarter of said Section 23; thence West a distance of 45.00 feet to the West line of the North- west quarter of the Southeast quarter of said Section 23; tiieence North 60.17 feet along the West line of the Northwest quarter of the Southeast quarter of said Section 23, to the point of beginning. EXCEPTING THEREFROM any portion thereof lying within Parcel One described above; be, and the same is hereby, accepted by the City Council of the City of Anaheim, and that the City of Anaheim accept a conveyance of said property. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owner of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
