1962-0075RESOLUTION NO. 62R -75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 -60 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p rsons interested therein and from, its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that cer- tain.zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council. did fix the 23rd day of January 19 62 as the time, and the7ity 'ham bers in the City HETT"in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from 'the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there upon consider the summary of evidence presented at ,aid public hearing before the Planning Commission, its repo, t of f ridings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tile 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the, City of Anaheim, County of Orange, State of California, to wit: 61 -62 -60 The West 10 acres of the North 20 acres of Lot 15 in Block K of the Kraemer Tract, as shown on a Map recorded in Book 12, pages 87 and 88 of Miscellaneous Records of Los Angeles County, California. be excluded from the R -A. RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the following zone or zones, upon the conditions hereinafter set forth: That a strip of land 50 feet in width, lying south of and contiguous to the land to be deeded to the City of Anaheim along Anaheim Road for street widening purposes, shall be incorporated in P -L, PARKING- LANDSCAPING ZONE; That a strip of land 50 feet in width, lying east of and contiguous to the land to be deeded to the City of Anaheim along Dowling Avenue for street widening purposes, shall be incorporated in P -L, PARKING- LANDSCAPING ZONE; and That the balance of subject property shall be incorporated in M-1, LIGHT- MANUFACTURING ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit No. 1," on file with the City of Anaheim. 2. That landscaping shall be installed and main- tained in the P -L, PARKING LANDSCAPING ZONES; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim; and that said landscaping shall be installed prior to final building inspection. 3. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet -2- i width, from the center line of the street, among Anaheim Road for street widening pur- poses, and shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Dowling Avenue for street widening purposes. L{. That all engineering requirements of the City of Anaheim, along Dowling Avenue and Anaheim Road, such as curbs and gutters, sidewalks, street grading and paving+, ±drainage facilities, or other appurtenant -work shall be complied with as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer; and that said engineering require- ments shall be complied with at the time sub- ject property is developed. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Dowling Avenue and Anaheim Road for street lighting purposes, said amount to be paid at the time subject property is developed. 6. That Condition 3 above mentioned; shall be complied with within a period of 18O days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
