1961-7447RESOLUTION NO. 7447 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City'of Anaheim did hold a public hearing in Reclassification Proceed= ings No., 61 -62 -47 to consider an amendment to Title 18 o t e Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from :.rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a_' summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that �e Lain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of finding:; and recommendation of the City F; an- ning Commission, the City Council did fix the 12thday of December 19 1 ac the time, and the City Council h +m- bers in the City Ha 11 in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exo1usion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter et forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public, hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at ;aid public: hearing before the Planning Commission, its report of fi ndings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T Ie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61 -62 -47 The North 280 feet of the West 200 feet of the East half of the Southwest quarter of the Northwest quarter of the Northwest quarter of Section 16, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana,city of Anaheim, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County, being further described as the North 280 feet of the 'hest 200 feet of the East half of Lot 5, Helen and Lynch's Addition to Anaheim, as shown on a map thereof recorded in book 442, page 158, Deeds, records of Los Angeles County, California. be excluded from the C -1_ NEIGHBORH00D- COMMERCIAL ZONE, and incorporated in the following zone or zones: R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That subject property shall be developed in accordance with plans marked "Exhibits 1, 2, 3 and 4" on file with the City of Anaheim; provided, however, that the elevation plans shall be subject to re- view by the Planning and Building Depart- ments of the City of Anaheim. 2. That sidewalks shall be installed as re- quired by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and that said sidewalks shall be installed prior to final building inspection. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Pampas Lane, for street lighting purposes. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, which amount shall be paid at tiie time the building permit is issued. 5. That Condition No. 3 above mentioned shall be complied with within a period of 90 days from date hereof or such further time as the City Council may grant. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper. When not inconsistent with the context, words used in the present tense include the future; words in the plural number include the singular number; and words in the singular number include the plural number. The word shall is always mandatory and not merely directory. Abutting: Abut means to touch at the ends; be continuous; join at a border or boundary; terminate; to end at; to border on; to reach or touch with an end. Accessory: A building, part of a building or structure or use of which is subordinate to, or the use of which is incidental to that of the main building. Where fifty per cent (50 or more of the wall of an accessory build- ing constitutes a common wall with the main building or, if the roof of the accessory building at its full width or length as the case maybe, is a physical continuation of the roof of the main building, then such accessory building shall be counted as a part of the main building. Accessory Use or Building: An accessory use or building is a subordinate use or building customarily incident to and located on the same lot with the main use or building. Accessory Living Quarters: Living quarters within an accessory building for the sole use of persons employed on the premises or for temporary use by guests of occupants of premises, such quarters having no kitchen facilities used by guests of occupants of premises, such quarters having no kitchen facilities and not rented or otherwise used as a separate dwelling. 18.08.06 Advertising Structure: Any structure affixed to the sur- face of the land, a building or another structure designed, arranged, used or intended to be used for advertising purposes 18.08.07 Advisory Agency: The term "advisory agency" shall be,conm strued to mean the City Planning Commission or the Zoning Board if one is created by the City Council. 18.08.08 Adequate Access: Adequate access is hereby defined to mean reasonable and necessary provision for ingress and egress required for the use to,which property is devoted, and for the extension and maintenance of utility service and fire protection. 18.08.09 Airport: Airport means any area of land or water which is used or intended for use for the landing and take -off of aircraft at any appurtenant areas which are used or intende for use for airport buildings or other airport facilities or rights -of -way, together with all airport buildings and facilities located thereon. .18.08.10 Alley: Alley is any public space.or thoroughfare feet or less in width, but not less than feet in width, which has been dedicated or deeded to the public for public travel and which affords secondary access to abutting property. 18,08,11 Alteration: Alteration as applied to a building or structure is a change or rearrangement in the structural parts or in the exit facilities or an enlargement, whether by extending on a side or by increasing in height or the moving from one location or position to another. 18.08.12 Animal Hospital: Animal hospital is hereby defined to be a place for the care and treatment of pets and small domestic animals. 18.08.13 Apartment: A room or suite of two or more rooms in a multiple dwelling occupied or suitable for occupancy as a residence for one family. 18.08.14 Apartment Hotel- A building or portion thereof designed for or containing both individual c hst rooms or suites of rooms and dwelling units. 18.08.15 Apartment House: A multiple family dwelling for three or more families living independently �f each other and doing their cooking upon the premises. 18.08.16 Area Building: The building area is the aggregate of the maximum horizontal cross-section area of the main building on a lot, excluding cornices, eves, gutters, or chimneys projecting not more than feet, steps, one story open porches, bay windows not extending through more than one story and not projecting more than feet, balconies and terraces. 18.08.17 Article: Article means an article of this ordinance unless some other ordinance or statute is mentioned. 18.08.18 Attic: The uppermost floor of a building designed or in= tended for use as a storage space and not for liv quarters. 18.08.19 At Least Ten (10) Days: Whenever any provision of this ordinance or any state law requires at least ten (10) days notice to be given of any proposed act, hearing or other matter that says the period of time shall be computed by excluding the first day and including the last, unless the last day is a holiday, and then it is also excluded. 18.08.20 Automobile Compound: Any land area located on a lot, piece or parcel on which any resident is located or on contiguous land areas on which group houses are located, used or in- tended to be used for the storage of the private passenger automobiles of the occupants of the residents or group houses. 18.08.21 Automobile Parking: As used in this ordinance, the term "automobile parking" means any area devoted to the public parking of automobiles for hire. 18,08.22 18.08.23 18,08,24 Automobile Wreckings The disnaitie ±ng or wrecking of used motor vehicles or trailers or the storage, sale or dumping of dis mw t d or wrecked vehicles or their parts. 18,08,25 Auxiliary Use or Buildings Any use or building customarily incidental and accessory to the permitted use of a land area or the main building or structure thereon, 18.08.26 Babysittings Babysitting is hereby declared to be a home occupation, 18.08.27 Bachelor Apartments One room and bath, without cooking facilities, in a multiple dwelling. 18.08.28 dasements A story partly underground and having,one =half or more of its height below the average level of the adjoining ground. A basement, when designed for, or occupied as dwellings (rumpus rooms or recreation rooms without kitchens excepted), business or manufacturing, shall be considered a story. 18.08.29 Billboards Any structure affixed to the surface of the land, designed, arranged, used ar intended to be used exclusively for a sign. 18,08.30 18,08,31 18.08.32 18.08.33 18,0 Automobile Storages Automobile storage space when required by this ordinance means any permanently maintained space not less than 144 square feet in area on the same lot or parcel of land as Is located the structure which it is designed to serve so located and arranged as to permit the storage of and to be readily accessible under its own power to a passenger automobile of average size. Automobile Trailer Sales Lots. An open area used for the display, sale and rental of new and used motor vehicles and trailer coaches where no repair, remodeling'or re- painting is done. Blocks All property fronting upon one side of a street between intersecting and intercepting streets, or between a street and right -of -way, waterway, terminus of dead- end street or City boundary. An intercepting street shall, determine only the boundary of the block on the side of the street which it intercepts, Boards The term "board" is intended to mean and refer to a Zoning Board or other board that may be created and established by the City Council, Boarding Houses A building where lodging and meals are provided for compensation for f w .,.(5) but not more than fifteen (15) persons, not including rest homes. Boarding Schools A school in which pupils are boarded and lodged, as well as taught. Borrow Pits A borrow pit means any place or premises where dirt, soil, sand, gravel, or other material is removed by excavation or otherwise below the grade of surrounding land for any purpose other than that nec- essary and incidental to grading or to building con- struction or operation on the premises. 18.08.35 18.08.36 18i0P,:37 Buildings, Group: Two or more buildings entirely or partly separated by walls, each designed, arranged, used or intended to be used as one apartment. 18.08.38 Building lies_ht: Building height means the vertical dis- tance from the grade to the highest point of the coping of a flat roof or to the deck line of a mansaid roof or to the average height of the highest gable of a pitch or hip roof. 18,08.39 Building Line: Building line is the line between which and the street line or lot lane no building or ether structure or portion thereof, except as provided in this Code, may be erected above the grade level. The building line is considered a vertical surface intersecting the ground on such line. 18.08.40 Building Line Setback: Building setback line is a building line back of the street line. 18.08.41 18.08.42 18.08.43 Building Volume: The cubic foot contentof the building within the levels of the height of that building. 18.08.44 18.08.45 Building A building is any structure built for the support,, shelter or enclosure of persons, animals, chattels, or property of any kind, and entirely separated from any other structure by space or by walls in which there are no communicating doors or windows or similar openings. Building Area: Building area is the aggregate of the maximum horizontal cross-section area of the main building on a lot, excluding cornices, eves, gutters or chimneys projecting not more than feet, steps, one -story open porches, bay windows not extending through more than one story and not projecting more than feet, balconies and terraces. Buiidial, Main: A building within which is conducted the principal use permitted on the lot as provided by this ordinance. Building Site: The ground area of one or more lots, as defined herein, when used in combination for a building or permitted group of buildings, together with all open spaces as required by this Title, and when so combined as a single building site the common line dividing any two or more contiguous lots so combined may be exempt from the provisions requiring side yards with respect thereto, Bungalow Court: A group, of three or more detached one story one or two family dwellings located upon a single lot, together with all open spaces as required by this Title. Business or Commerce: The purchase, sale or other trans- action involving the handling or disposition of any article, substance or commodity for livelihood or profit; or the management of office buildings, offices, recreational or amusement enterprises or the maintenance and use of offices, structures and premises by professions and trades rendering services. 18,08.46 18.08.47 18.08.48 18.08.49 18.08.50 18.08.5,3 18.08.54 18.08.55 18.08.56 18.08.57 Bus Blocky Any land used or intended to be used for the storage or lay-oaer of three or more passenger buses or motor coaches used in public transportation. Business Sign° A business sign is a sign which directs attention to a business or profession conducted upon the premises. An advertising sign is a sign which directs attention to a business, commodity, service or entertain- ment conducted, sold or offered elsewhere than upon the premises. A "For Sale" or "To Let" sign relating to the property on which it is displayed shall be deemed a business sign. Bus Stations A "Bus Station" is any location off a public street where public buses receive or discharge passengers. Bus Garages A "Bus Garage" is any building designed, arranged, used or intended to be used for the storage of three or more passenger motor b_R,ses or motor coaches used in public transportation. Camp, Public. Any area or tract of land used or designed to accommodate two or more automobile trailers, including trailer camps, or two or more camping parties, including tents or other camping outfits. 18.08,51 Camp °frailer° See "Camp, Public." 18.08.52 Car ort or "Porte Cochere"m An accessory residential use consisting of a reserve space, roofed or unroofed, and attached to a side of a,dwe1ling and established for, the convenient loading and unloading of passengers. Car Wash A "Car Wash" is any building, lot, space or area where motor vehicles are washed for compensation or without compensation. Cellar. Cellar is that portion of a building between floor and ceiling which is wholly or partly below grade and so located that the vertic =l distance from grade to the floor below is equal to or greater than the vertical distance from grade to ceiling. Center Line When referred to in this ordinance the "Center line" means the center line of a street, alley, highway or right -of -way. Chapter. The term "chapter" refers to the chapters in this ordinance. Church. Church as used in this ordinance shall mean an establishment,the principal purpose of which is religious worship and for which the principal structure contains the sanctuary, and including accessory uses in the main structure or in a separate building, including Sunday School rooms, assembly rooms, kitchen, library room and one family dwelling unit, but excluding day care nurseries and facilities for residence of or training of religious orders. 18,08,58 18008059 18008060 18,08061 18008,63 18008064 18.08.65 211.1g The term 'city" when used in this ordinance shall mean and refer to the City of Anaheim. C1 inic o A clinic is an institution connected with a medic ,c1 college or hospital devoted to the examination and treatment of patients. Club o An association of persons for some common non profit purpose, but not including groups organized primarily to render a service which is customarily carried on as a business. Commercial Deh:yvdut,on Pianto A Commercial Dehydration Plant means and includes any and all plants, whether com- pleted or not used or erected or maintained for use for or in connection with the separation of sand, water and other foreign substances from oil and other hydrocarb•ns and includes each and every structure, building, tank or facility and each and every piece of apparatus, machinery used or erected or maintained for use, for or in connection with the erection, operation or maintenance of such plant; excepting, however, any dehydration plant which is operated and maintained ,xclusi vely as a part of the production equipment (as herein defined) of and for any well or wells operated and maintained by the person operating and main taining such dehydration plant and which plant is not used for the dehydration or treatment of any oil or other hydro- carbons produced or obtained by or from any well or wells not operated and maintained by said person operating and maintaining such dehydration plant. 18,08062 Commission° A commission means the City Planning Commission of the City of Anaheim. Conforming Bui lld to o A conforming ing bu,i ld ing means o a in the R Zones a conforming building is one which fully meet the requirements of the State Housing Act and the Uniform Building Code as they pertain to residential buildings and which building also nforms to the require- ments of this ordinance. in the matter of height, yards and area coverage and is limited to the number of dwelling units prescribed for the zone in which it is located; and (b) in the and "M" Zones a conforming building is one which fully conforms to the structural design, building materials, and their assembly as prescribed for commercial or industrial buildings, by the Uniform Building Code and which building fully conforms to the requirements of this ordinance with respect to the zone in which it is located. Such use of the land and buildings shall be inharmonyY with the uses on abutting properties in the same zone. Conditional Use° A conditional use is a use that is authorized in a one by conditional use permit as authorized by the provisions of this ordinance and one that will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located and where the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety or 18008066 18, o8.73 general welfare, a,rn-1 where t? e traffic generated by the propo! use will not impose an undue burden upon the streets and highways deigned and improved to carry the traffic in the area, Convalescent Home? The term "Council" shall mean and refer to the City Council of the City of Anaheim. 18,08.68 County The term "County" shall mean and refer to the County of Orange. 18.08.,69 Courtg A court is an unoccupied open space other than a yard on the same lot with a building which is bounded on two or more sides by the walls of such building. 18008.70 Court Inner o An inner court is a court enclosed on all sides by exterior walls of a building or by exterior walls and lot lines on which walls are allowable. 18.08.71 Court„ ©niter An outer court is a court enclosed on not more than three sides by exterior walls and lot lines on which walls are allowable, with one side or end open to a street, driveway, alley or yard. 18.08.72 C=urb„ ;alo,pe° That portion of the curb sloping downward from the top of the curb to an access driveway. Curb level The curb level for the purpose of measuring the height of any portion of a building is the mean level of the garb in front of such portion of the building.. But where a building is on a corner lot the curb level is the mean level of the curb on the street of greatest width for the purposes of this ordinance. If such greatest width occurs on more than one street, the curb level is the mean level of the curb on that street of greatest width which has the highest curb elevation. The curb level for the purpose of regulating and determining the area of yards 9 courts a d opera spaces Is the mean level of the curb at that front of the building where there is the highest curb elevation. Where no curb elevation has been established or where a front yard setback of 25 feet or more is provided the average level of the land immediately adjacent to the build- ing prior to any excavation or fill shall be considered the curb level. 18.08.74 Dairy An establishment or enterprise maintaining more than two cows for the commercial production and sate of milk and dairy products, 18.08.75 Day Nursery Any group of buildings, building or portion thereof used primarily for the daytime care of children, 18.08.76 Dehydration Plant? A commercial dehydration plant means and includes any and all plants, whether completed or not, used or erected or maintained for use for or in connection with the separation of sand, water and other foreign substanc from oil and other hydrocarbons and includes each and every structure building, tank or facility and each and every 18.08.77 18, 08.78 18.o8,79 18.08.80 i8,o8.81 18. o8.82 18,o8.83 18.o8.84 piece of app xrat.us, machinery or equipment used or erected or maintained for the use for or in connection with the erection, operation or maintenance of such plant; excepting, however, any dehydration plant which is oper- ated and maintained exclusively as a part of the production equipment (as herein defined) of and for any well or wells nperated and maintained by the person operating and main- taining such dehydration plant, and which plant is not used for the dehydration or treatment of any oil or other hydro- carbon produced or obtained by or from any well or wells not operated and maintained by said person operating and main- taining such dehydration plants Qpth of Lots The depth of a lot is the mean distance from the street tine of the lot to its rear line meaured in the general direction of the side lines of the lotto Derrick° Derrick means any structure, improvement, equip= ment or facility and each and every part of any thereof, whether completed or not and which is or are required or used or useful for or in connection with drilling or oper- ating or maintaining a well for the production of oil, gas or other hydrocarbon from the earth, together with all parts of and appurtenances to such structure, Improvement equip meat or facility, including (but not limited to) any foundations and silks therefor, tower, pump houses, engine houses, belt houses or housing, boilers, boiler plants, pipe racks, postings, walkways, mud ditches, bull wheels, calf wheels, bank wheels and crown block. Director o Director means the Director of the Planning Department of the City of Anaheim. Districts The term "district" means any district authorized to be created and established under the laws of the State of California. Domestic Animals The term "domestic animal" as used in this ordinance shall mean any animal that is tame as distinguished from wild animals or any animal which is associated with family life, accustomed to live in or near the habitation of men, an pegs, beasts of burden or otherwise. Dormitor.yo A dormitory is defined as a sleeping room or building containing a series of sleeping rooms. Drive -in Restaurants° Restaurants which provide facilities and services for serving and consumption of food for per- sons remaining in automobiles. Dr Cleanings The term "dry cleaning" sh =11 include cleaning of textiles, fabrics, garments or other articles by use of solvents other than water, extracti,n of the solvents therefrom and drying the same. 18.08,85 DryP Cleaning Unit° The term "dry cleaning unit' includes the machinery or equipment in which textiles, fabrics, garments or other articles are carried through a complete cleaning cycle. A dry cleaning unit may consist of one or more detached component machines. 18.08,86 Dump Dump means an area devoted to the disposal of refuse, including incineration, reduction or dumping of ashes, garbage, combustible or noncombustible refuse or for dead animals. 18.08.87 18.08.88 18.08.89 18.08.90 18.08.91 18.08.92 18.o8.93 18.08.94 18.08.95 18.08.96 18.08.97 piex Residence g A building entirely separated from any other building by space, design, arrange, used or intended to be used as apartments or dwelling units for two families. Dwelling Unit One or more rooms in a dwelling or apartment hotel designed for occupancy by one family for living or sleeping purposes and having only one kitchen. asilina A detached building 'designed ex- clusively for occupancy for one family, asuLaa A building designed exclusively for occupancy by two families living independently of each other. atalasa_BALLiaag A building or portion thereof, designed for occupancy by three or ,more families living independently of each other. Easementg The term "easement" as used in this ordinance means the right in the land or a portion of the land of another to use said land or said portion for construction, maintenance of streets, highways and alleys and for the installation and maintenance of utility lines and facilities, and for the purpose of ingress and egress to other property and for any other necessary public purposes. Educational Institution g The term "educational institution" means elementary, junior high, high schools, colleges, universities, academies or other schools in general academic or physical instruction.in general or special branches of learning to pupils or students. Erectedg The term "erected" means the construction of any building or the structural alteration of a building, the result of which would be to change the exterior walls or roof or to increase the square foot floor area of the interior of the building. Essential Service The term "essential service" is the erection, construction, alteration or maintenance by public utilities or municipal departments or commissions of under= ground or overhead gas, electric, steam or water transmission or distribution systems, collection, communication, supply or disposal systems, including poles, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants and other similar equipment and accessories in connection therewith, but not including buildings reasonably necessary for furnishing adequate service by such public utilities or municipal departments or commissions for the public health, safety or general welfare. Establish Grade g The term "establish grade" means the average grade of the fixed ground level at the center of all walls of a building. The term "frontage" as used in this ordinance, means the frontage of a parcel of property upon a public street or place. 18.08.106 Expiosiveso The terms"explosive: xnd "explosives" when- ever used in this ordinance include blasting caps or other detonating or fulminating caps, or detonator or electric caps, gun powder, blasting powder, dynamite and every other explosive substance having a power equal to or greater than that of ordinary black powder, but do not include said substances in the form of mixed ammunition for small arms. Fire Escape o "Fire escape" means an auxiliary means. of emergency escape from a building, as defined or designated by the Fire Department of the City of Anaheim. ioor Area (rnoss o For the purpose of determining the ratio of floor area of a building to the area of the lot, the "gross floor area" shall be the sum of the gross horizontal areas of the several floors of the building, excluding areas used for accessory garage purposes and such basement and cellar areas as are devoted exclusively to uses accessory to. operation of the building. All horizontal dimensions shall be taken from the exterior faces of walls, including walls, or other enclosures of enclosed porches. Foster Faml iyr Layr Care Home Foster family day care home mean: a residence licensed by.the State of California to be used to care for not more than .six (6) children by day, with or without compensation. A foster family day care home may be considered to include a day nursery conducted on a half day basis when such home is licensed by the State of California, provided the number of children cared for at any one time shalt' not exceed six t'6). Filling Station. A service station to supply motor fuel and oil to motor vehicles and including grease rack or elevators and providing `minor tire and battery serav:ci.ng; sales of accessories; etc. Front Wali° The term "front wall" as used in this ordinance, means that portion of a building or structure, including walls, foundations, porches or any other part of said structure facing the front of a lot or building site or the ms street or thoroughfare upon which it is located and which the front wall, as herein defined, shall not extend beyond the front yard setback line. 18.08.10 18.08.108 18.08.113 1 8.0 8. 11 4 18.08.117 Front Yard Setbackg Front yard setback mean tending across the front of a lot measured between the side yard line and being the minimum horizontal distance between the highway line and thermin building and any projection thereof. On corner lots the Planning Commission shall determine which is the front yard. In the absence of such determination, the front yard shall be provided on the highway on which the frontage of the building faces. Gaula A bus garage is any building designed, arranged, used or intended to be used for the storage of three (3) or more passenger motor buses or motor coaches used in public transportation. 18.08.109 LaLa22 Private g An accessory building or an accessory portion of the main building designed to be used for the shelter or storage of vehicles owned or operated by the occupants of the main building. 18.08.110 Gataat A building, other than a private garage, used for the care, repair or equipping of automobiles, or where such vehicles are kept for remuneration,hdre or sale. 18.08.111 arage A building or part of other than a,private garage used for the storage of motor vehicles in which ser- vice station activities may be carried on. 18.08.112 aulL A truck garage is any building designed, arranged, used or intended to be used for the storage of motor trucks, truck trailers, tractors and commercial vehicles exceeding two-ton capacity. Grade g The finished grade of a land area improved with a building is the elevation of the surface of the land adjoining the building. The established grade of a land area whether vacant or improved, is the elevation of the sidewalk at the street line as fixed by the City., Ground Area of Buildinag The area of the ground bounded by lines projected to include all walls, bays, balustrades, belt courses, cornices,: fences, fire escapes and other fixtures (excepting entrance canopies, fences on lot lines adjoining alleys, business,commercial, manufacturing and industrial boundary lines and elsewhere fences of railings, wire, rods, or similar construction so as not to shut out light) extending more than four feet above the finished grade of the land area and all uncovered spaces more than four feet above the finished grade of the land which are not open to a public way. 18.08.115 Group Houses g Two or more separate buildings each conLain- ing one or more dwelling units. 18.08.116 Guest House or Accessory Livin Quarters g Living quarters within an accessory building for the use only of persons employed on the premises or guests of the occupants. A standard secondary highway is 4 lanes in width with parking provided on both sides of 64 feet of roadway. Modification may be made by eliminating parking and reducing lane widths, where extenuating circumstances exist. However, it shall still provide for a minimum of 4 Banes of traffic, 18,08,122 18,08,123 18b080 121i. 18,08,125 18,08,126 Ht1g Sancti° Hog ranch means any premises where three or more weaned hogs are maintained, Home Occu'a.tions Any use customarily conducted entirely within a dwelling and carried on by the inhabitants thereof, which use is clearly incidental and secondary to the use of the structure for dwelling purposes, and which use does not change the character thereof nor does not adversely affect the uses permitted in the district of which it is a part. Home occupations shall not permit the sale on the premises of products not produced thereon. No signs shall be displayed except as specifically permitted by this ordinance. No person shall be employed other than do- mestic help, Hospital? Any building or portion thereof used for t* accommodation and the medical care and treatment of sick, injured or infirm persons, and including sanitariums, alcoholic sanitariums, institutions for the cure of chronic drug addicts, but not including buildings or hospitals for the treatment of mental and nervous dis- orders, but not excluding surgical and post surgical treatment of mental cases, Hospitals Mentago Mental hospital means an instisut licensed by the State agencies under the provisions of law to offer facilities, care and treatment for cases of mental and nervous disorders, but not licensed to pro- vide facilities and services in surgery, obstetrics and general medical practice. Fish are nOt to be counted as household pets, and their number is not restricted by this ordinance. Incidental Use: The term "incidental use" as used in this ordinance means a use that is subordinate to the main authorized use permitted within a given building or upon a given lot or premises and one that is authorized in the zone in which exercised and compatible with the main or primary use. Industry: The manufacture, fabrication, processing, re- duction or destruction of any article, substance or commodity or any other treatment thereof in such a manner as to change the form, character or appearance thereof, and including storage, elevators, truck storage yards, dumps, junk yards, warehouses, wholesale storage, and other similar types of enterprise. The term "industry" shall also include basic research activities in the fields of engineering, physics, chemistry, and other physical Science. Institution: An institution is, an established or organized society or corporation. It may be private in its character, designed for profit to those composing the organization or public, and charitable in its purposes. Intent and Purpose: The term "intent and purpose" as used in this ordinance means the interpretation of the pro- visions hereof to carry out the intent of the legislative body in enacting any provision hereof and to carry out the evident purpose thereof. Junk: Junk is any worn out, cast off, or discarded article or material which is ready for destruction or has been collected or stored for salvage or conversion to some use. Any article or material which unaltered or unchanged and without further reconditioning can be used for its original purpose as readily as when new shall not be considered junk. Junk Yard: Any lot or the use of any portion of a lot for the dismantling or wrecking of automobiles or other motor vehicles or machinery, or for the storage or keeping for sale of parts and equipment resulting from such dis- mantling or wrecking, or for the storage or keeping of junk including scrap metal or other scrap materials. Kennel: Kennel means a place where four or more adult doga or cats or any combination thereof are kept, whether by owners of the dogs and cats, or by persons providing facilitie and care, whether or not for compensation. An adult dog or cat is one that has reached the age of four months. Lot g (1) A parcel of property as shown on the effective date of this ordinance as a delineated parcel of land with a number or other designation on a plat recorded in the office of the County Recorder of the County; or (2) a parcel of real property not delineated as in (1) above and abutting at least one public street or alley and held under separate ownership from adjacent property prior to the effective date of this ordinance; or (3) a parcel of real property not delineated as in (1) above and containing an area not less than the prescribed minimum square footage and lot widths required for the zone in which it is located and abutting at least one public street or alley if the same WAS a portion of the larger piece of unsubdivided real pro- perty held under single ownership prior to the effective date of this ordinance. Lot Area The total horizontal area within the botuode lines of a lot. For the purpose of determining lot area in the case of an irregular, triangular or gore-shaped lot, a line most nearly parallel to the front lot line Other lines are side-lot lines. MAItistRiatiwyg Major highway means a major highway as shown on the master plan of highways of the City of Anaheim, County of Orange or the State of California. 18.08.153 Medical Dental Building° Medical dental building means a building or a group of buildings designed for the use of and eecupied and used by, physicians and dentists and others engaged professionally in such healing arts for humans as are recognized by the laws of the State of California, in- cluding the installation and use of therapeutic equipment, x -ray equipment, or laboratories, chemical, bio- chemical and biological laboratories used as direct accessories to the medical-dental professiorL 9 dental laboratories including facilities for the making of dentures or pre- scription and pharmacies limited to retail dispensing of pharmacuet icai and sickroom supplies, (but not room or orthopedic equipment) provided there shall be no exterior display windows or signs pertaining to such accessory uses other than a directory sign. 18.08.154 Manate A permanent roofed structure attached to and supported by the building and projecting over public property. 18.08.155 Minimum Floor Area A minimum floor area shall be determined by measuring in a horizontal plane the floor area enclosed by the outside walls enclosing the dwelling unit. 18.08.156 Motel or Tourist Court° Motel or tourist court means a building or a group of attached,. detached, buildings containing individual sleeping or living units where a majority of such units open individually and directly to the outside, and where a garage is attached or a parking space is conveniently located to each unit, all for the temporary use by automobile tourists or transients and such words shall include auto courts and motor lodges. Non-ConformiaLliailliallg Non-conforming building means a building or portion thereof which was lawfully erected or altered and maintained, but which because of the application of this ordinance to it no longer conforms to the reg- ulations of the one in which it is located as 'defined by this ordinance. Non-Conforniiiiliilig Non-conforming use means a use which was lawfully established and maintained, but which, because of the application of this ordinance to it no longer con- forms to the use regulations of the zone in which it is located. A non-conforming buildtng, or non-conforming portion of a building, shall be deemed to constitute a non-conforming use of the land upon which it is located. Only? As used in referring to permitted uses, the word "only" shall be construed as specifically prohibiting all unmentioned uses, buildings and structures except those qualifying within the sections entitled "other permitted buildings and uses," and those fix° which a conditional use permit is Issued. 18.08.163 Ordinanceg Ordinance means an ordinance of the City of Anaheim. g Outdoor advertising display means any card, paper, cloth, metal, glass, wooden or other display or device of any kind or character whatsoever placed for outdoor advertising purposes on the ground or on any tree, wall, rock, structure, or thing whatsoever. O8. 170 18.o8.171 18.08,172 of owners acting ,jointly, involving a related group of uses, planned as an entity, and therefore susceptible of development and regulation as one unified land unit, rather than as a mere aggregation of individual buildings and structures located on separate lots. Such a development has a predominant developmental feature which serveu5 to unify and organize the development. Planned Unit Residential Develo mp ent° A planned unit re- sidential development is a large -scale development of a minimum size of three (3) acres, to be constructed by a single owner or group of owners acting jointly, involving a related group of residences which are planned as an entity and therefore susceptible of development and regulatio as one unified land unit. Such planned unit residential developments shall have as predominant unifying developmental features. 1) common open and recreational acres; and (2) all vehicular storage, access and circulation shall be peripheral Planned Unit Industrial Deyelo•ment o A planned unit in- ..w dustrial development is a large scale development of a minimum size of three (3) acres, to be constructed by a single owner or group of owners acting jointly, involving a related group of buildings to be used for industrial purposes (cf. definition of "industry"); which buildings are planned as an entity and therefore susceptible of development and regulation as one land unit. Such planned unit industrial development shall make detailed and adequate provision for necessary streets, loading and parking areas, rail lead tracks, utilities, arterial highway setbacks and landscaping, and other common facilities. Parcel of Land Parcel of land means a cont.iguous,quantity of land in the possession of, or owned by or recorded as the property of the same claimant or person. Parcel Delivery St.ationo A building in which commodities sold at retail within the Anaheim area and packaged by the retailer are assembled and sold and routed for delivery to retail customers located within or without the Anaheim area. Parking Area Public o An open area other than a street, alley or place used for the temporary parking of more than four automobiles and available for public use, whether free, for compensation, or as an accommodation for clients or customers. Parkin S ace Automobile. Space within a building or parking area for the temporary parking or storage of one automobile. Person. Person means any individual, firm, copartnership, ,joint venturer, association, social club, fraternal or- ganization, corporation, estate, trust, business trust, receiver, syndicate, this and any other county, city and county, municipality,district or other political sub- division, or any other group or combination acting as a unit. Person, Interested. Any person having a legal or equitable interest in any land which is the subject of any application filed with the City Planning Commission or the City Council pursuant to the provisions of this ordinance. The term shall also include any person, firm or corporation who has a contract or an option to acquire such an interest, or the duly authorized agent of such person. 18.o8.173 18.o8.174 18.08.175 18.08.176 18.08.177 18,08.178 18.o8.179 18.o8.180 Pest Control 0 :2 Pest control operator means a person who engages in the business of eradicating or controlling any pest which is, or is liable to be dan- gerous, or detrimental to agriculture or buildings, by the application of any substance, method or device, or engages in the business of preventing, destroying, repelling, mitigating or correcting any disorder of plants by these same means or both. Planned Highway Line. A line showing the proposed, pre- sently planned width of any street or highway right of way which is in excess of the presently existing right of way line. Private Clubo Private Club means an association of persons, whether incorporated or unincorporated, organized for some common purpose, but not including a group organized solely or primarily to render a service customarily carried on as a commercial enterprise. Private Park A private park is a park owned, operated and maintained by private persons, firms, corporations, or associations. Production Equipment. Production equipment means and includes pumping equipment, tubing, pipes, gauges, meters, valves, oil and gas separators, sumps, flow tanks, production tanks, shipping tanks, lease tanks, shipping pumps, loading racks, and all other structures, machinery, equipment and facilities and each and every part of any thereof (whether completed or not) required for or used, or useful, in connection with the operation, repair, reconditioning, redrilling or main tenance of a well or well -hole, and the collection, handling and delivery of oil, gas or other hydrocarbons therefrom, and which structures, machinery, equipment and facilities are not included in the "derrick," "well, or "well -hole" as herein defined; and also operated or maintained by or in behalf of the operator of said well for the purpose of separating sand, water and other foreign substances from the oil, gas or other hydrocarbons produced or obtained by said operator prior to shipping or delivering said oil from the shipping tanks or lease tanks at the well or in the vicinity thereof. Profession. Profession means a calling in which the person has acquired professed attainment in specialized knowledge of an advanced type in a given field of arts, science or learning and In which the skill involved is predominantly mental or intellectual as distinguished from physical or manual skill. Professional Offices. Professional offices means offices maintained and used as a place of business conducted by persons engaged in the recognized professions. Radio Transmitter Station. A station constructed and used for the transmission of radio programs, music, news, ad- vertising, political activities and other communications and activities usually and customarily transmitted through radio transmitter stations. 18,08,181 Radio Transmitter Towers. Towers erected and maintained for use by radio transmitter stations. 18.08.182 18,08,183 18.08. 18.08.185 18.08.189 18.08.190 Railroad Riyht of Way. A strip of land with tracks and auxil Lary facilities for track operation but not including depots, loading platforms, stations, train sheds, warehouses, car shops, car yards, locomotive shops or water towers. Read, Mix Concrete Plant. A place where concrete is produced and ready mixed, including equipment and machinery for mixing cement,and trucks and vehicles for delivery. Reclassification° Reclassification means a change in zone boundaries in the manner provided in this ordinance and by amendment hereto by the adoption of an ordinance for that purpose. Refinery. Refinery means and includes any and all plants whether completed or not used or erected or maintained for use for, or in connection with the separation of oil or other hydrocarbons into any of its or their component parts, whether by cracking, distillation or other process, or for or in connection with making or deriving from oil or other hydrocarbons any other products or by- products and includes each and every structure, building, tank or facility and each and every piece of apparatus, machinery or equip- ment used or erected, or maintained for use for, or in connection with, the erection, operation or maintenance of any such plant. 18.08.186 Report. The term "report" means any report required or authorized by the provisions of this ordinance. 18.08.187 Retiuired Areao The term "required area" as used in this ordinance means the area of a lot which is shown on a part of a subdivision recorded as a final map or filed as a record of survey in accordance with law, and the minimum area required In any of the zones created and established by this ordinance. 18.08. 188 Required Open Spaces o The term "required open spaces" means all spaces required to be kept open from the ground to the sky as required by any of the provisions of this ordinance in any of the zones hereby created and established. Residence Residence means a building designed as living quarters for persons doing their own cooking in :itch building which either complies with, or was erected before the effective date of the zoning laws of the City of Anaheim or the establishment of the zone in which such residence is situated. Rest Home, Convalescent Home or Guest Home Rest home, convalescent home, or guest home means a home operating as a boarding house and In which nursing, dietary and other personal services are furnished to convalescents, invalids and aged persons,:but in which are kept no per- sons suffering from a mental sickness, disease, disorder, or ailment, nor from a contagious or communicable disease, and in which are performed no surgery, maternity or other primary treatments such as are customarily provided in sanitariums or hospitals or in which no persons are kept or served who normally would be subject to admission or commitment to a mental hospital. 18.o8.191 18.08.192 18.08.193 18.08.194 18.08.195 18.08.196 18.08.197 School, Boarding: A school in which pupils are boarded and lodged as well as taught. 18.08.198 School, Dancing: A school where the students are taught dancingc 18.08.199 School, Elementary Junior High and High: An institution of learning which offers instruction in the several branches of learning and study required to be taught in public schools by the Education Code of the State of California. 18.08.200 18008.201 18.08.202 Roadside Stand: A roadside stand is a structure, shelter, building or other place upon or along a highway where fruit: vegetables, food, goods, wares and /or merchandise are sold. Roof: Roof means a structural covering over any portion of a building or structure including the projection beyond the walls or supports of the building or structure. An open-work covering shall not be considered a roof if the upper horizontal surface area of the component solid portions thereof do not exceed twenty per cent (20 of the area of the covering. Room: Room means an unsubdfvided portion of the interior of a dwelling excluding bathrooms, kitchens, closets. hallways and service porches. Rooming House: A rooming house is any dwelling in which more than three persons either individually or as families are housed or lodged for hire with or without meals. A boarding house or furnished room house shall be deemed a rooming house. Rumpus Room or Family Rooms Rumpus room or family room means a room or an area within a dwelling or in a building accessory to a dwelling designed, equipped or used as a recreation room, including but not limited to games, music, refreshments and facilities for serving, and similar general utility purposes, but which room shall not be used as a separate dwelling unit. Sanitarium: Sanitarium means a health station or retreat or other place where resident patients are kept, and which specializes in giving clinical, temporary and emergency services of a medical or surgical nature to patients and injured persons and licensed by state agencies under provisions of law to provide facilities and services 2L surgery, obstetrics and general medical practice as distinguished from the treatment of mental and nervous disorders, but not excluding surgical and postsurgical treatment of mental cases. School, Parochial: A school maintained and conducted by a church or religious organization. School, Private: A private school is one that is maintained and conducted by private individuals, persons, firms or corporations.
