A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AMENDMENTS
TO THAT CERTAIN AGREEMENT MADE AND ENTERED
INTO BY AND BETWEEN THE CITY OF ANAHEIM
AND JOE JORDAN, ON SEPTEMBER 5, 1961,
WITH REFERENCE TO THE FURNISHING OF PLANS
AND SPECIFICATIONS FOR THE CONSTRUCTION OF
A CENTRAL LIBRARY BUILDING IN THE CITY OF
ANAHEIM.
WHEREAS, the City of Anaheim and Joe Jordan,
Architect, have heretofore entered into an agreement dated
September 5, 1961, relating to architectural services and the
preparation of plans and specifications for a Central Library
Building in the City of Anaheim; and
WHEREAS, the City has determined to construct a
basement area in said Central Library and to construct said
Central Library Building so that it will be capable of expanding
to a third floor at some future date; and
WHEREAS, the City Council does find that said agree-
ment dated September 5, 1961, should be amended and said
Architect authorized to proceed upon plans and specifications
beyond those originally contemplated in said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that that certain agreement dated September 5,
1961, made and entered into by and between the City of Anaheim
and Joe Jordan, Architect, relating to architectural services
and the preparation of plans and specifications for a Central
Library Building in the City of Anaheim be, and the same is
hereby, amended and said Architect is hereby authorized to
proceed upon plans and specifications beyond those originally
contemplated in said agreement dated September 5, 1961, upon
the following terms and conditions:
1. That paragraph 4(f) of said agreement of
September 5, 1961, shall be amended to read
as follows:
"f. ARCHITECT agrees that the entire project
will be designed and planned in such a manner
as not to exceed a total ccst of
$1,251,370.00, including architectural
fees, equipment, landscaping and incidental
expenses."
2. That paragraph 6(a) of said agreement of
September 5, 1961, shall be amended to read
as follows:
"a. The CITY agrees to pay the ARCHITECT
for his services performed hereunder a
fee of 8% of the estimated cost or
contract price of the construction,
whichever is least, of that portion of
the Building which is based upon the
drawings, plans and construction

specifications prepared and provided by
the ARCHITECT; PROVIDED HOWEVER, that
the total fee to be paid the ARCHITECT
hereunder shall not exceed the sum of
$88,620.00, plus ~ny authorized additional
fee for extra services. Such fee shall
become due and payable at the times and
in the manner provided hereinafter."
BE IT FURTHER RESOLVED that the City of Anaheim enter
into an amendment to said agreement dated September 5, 1961,
embodying the terms and conditions hereinabove set forth; and
that the Mayor and City Clerk be, and they are hereby, authorized
to execute said agreement for and on behalf of the City of
Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 14th day of November, 1961.

adopted at a regular meeting of the City Council held on the

and Schutte.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 14th dayaf
November, 1961.
