1961-7339RESOLUTION NO. 7339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE REPORT OF THE SUPERINTENDENT OF STREETS RELATING TO THE CONSTRUCTION AND COMPLETION OF CURBS IN THE CITY OF ANAHEIM AS AUTHORIZED AND DIRECTED IN RESOLUTION NO. 6491. Pub Works WHEREAS, on the 29th day of November, 1960, the City Council did adopt Resolution No. 6491 instructing the Superin- tendent of Streets to post certain property, notifying the owners thereof to construct curbs and sidewalks upon and along certain streets where sidewalks or curbs, or both, for a total frontage of fifty per cent or more on one side of the street, have already been constructed, and naming the owners of the parcels of property affected, and containing a description of said parcels; and WHEREAS, heretofore, to wit, on the 13th day of December, 1960, the City Council did hold a public hearing to hear protests, if any, by the property owners against the construction of side- walks and curbs and did pass Resolution No. 6542 overruling the protest made and finding and determining that the construction should proceed, and directing the Superintendent of Streets to cause the construction of said curbs and sidewalks upon and along the property as directed in said notices, unless the property owners should commence said construction within sixty (60) days after the giving of said notices and diligently and without interruption prosecute to completion; and WHEREAS, the property owners did not so commence said construction and the Superintendent of Streets did cause the construction to be done; and WHEREAS, upon completion of the construction, the Superintendent of Streets did cause notice of the cost of construction and the time and place of hearing the report of said Superintendent of Streets to be given in the form and manner directed by Sections 5881, 5877, 5878, 5878.1 of the Streets and Highways Code of the State of California; and WHEREAS, the 7th day of November, 1961, at the hour of 7 :00 o'clock P.M. in the Council Chamber in the City Hall was thereby fixed as the day, hour and place when the City Council would hear and pass upon a report by the Superintendent of Streets of the cost of the construction together with any objections or protests, if any, which might be raised by any property owner liable to be assessed for the cost of such construction, and any other interested persons; and WHEREAS, the City Council did hold and conduct said hearing on the 7th day of November, 1961, at the hour of 7 :00 o'clock P.M., in the Council Chamber in the City Hall, in the City of Anaheim, for the purpose of hearing and passing upon said report of the Superintendent of Streets and for the further purpose of hearing and passing upon all objections or protests for the cost of construction; and -1- WHEREAS, the Superintendent of Streets did present his report specifying the work which had been done, the cost of construction, a description of the real property in front of which the work had been done, and the assessment against each lot or parcel of land proposed to be levied to pay the cost thereof, and at said time and place no one appeared to object or protest the cost of such construction. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does find and determine that no person appeared to object or protest to the cost of construction of said curbs and sidewalks, nor filed any written protests and that the report of the Superintendent of Streets as submitted should be confirmed. AND BE IT FURTHER RESOLVED that the cost of construction as hereinafter set forth shall be and is hereby assessed against the parcel of property fronting upon the sidewalk and curb so constructed as hereinafter set forth, and such cost so assessed, if not paid within five (5) days after the date of this Resolution, shall constitute a special assessment against that parcel of property as hereinafter set forth and shall be a lien on the property for the amount as hereinafter set forth from the time of recordation of a notice of lien, which lien shall continue until the assessment and all interest thereon is paid, or until it is discharged of record. The description of the property, the owner or owners of record of said property, and the amount of the assessment is set forth as follows: 1. Lot 10, Tract No. 2015 (Assessor's Parcel #128 433-10) Owners: Charles W. Jacobson and. Ruth H. Jacobson, husband and wife, as joint tenants. Amount of Assessment $112.14 2. Lot 32, Tract No. 2015 (Assessor's Parcel #128- 431 -30) Legal Owner: Miles Thomas Company, a Limited Partnership, composed of Miles Thomas as General Partner, and Griffith Company, a corporation, as Limited Partner. Purchaser under Contract: Robert T. Bick, a single man. Amount of Assessment $162.00 3. Lot 82, Tract No. 2015 (Assessor's Parcel #128- 431 -03) Owners: Robert D. Johnson and Thelma Lee Johnson, husband and wife, as joint tenants. Amount of Assessment $126.00 THE FOREGOING RESOLUTION is approved and signed by me this 7th day of November, 1961.
