1961-7336RESOLUTION NO. 7136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No, 61.62 -29 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from t;: -rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation_ that the proposed amendment be adopted by the City Council and that ,:e r tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 7th day of November 19 61 as the time, and the MTCouncil .h +m- bers in the City H07 the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter° set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and dice there=- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its, repo, t of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council.of the City of Anaheim that T: le 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: -1- 61 -62 -29 That portion of lot 4 of South Placentia Tract No. 2, in the county of Orange, state of California, as per map recorded in book 5 page 42 of Mis- cellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the southwest corner of said lot 4; thence northerly 598.25 feet along the West line of said lot; thence easterly parallel with the North line of said lot to a point which is easterly 340.00 feet, measured along said parallel line and the prolongation thereof, from the center line of Cypress Avenue; thence southerly parallel with said West line to the southeasterly line of said lot; thence southwesterly along said southeasterly line to the South line of said lot; thence west- erly 85.90 feet along said South line to the point of beginning. EXCEPT the northerly 120.00 feet (measured along the westerly line) thereof. ALSO EXCEPT that portion thereof, described as follows: Beginning at the southwest corner of said lot 4, said corner having been construed by former deeds to be the intersection of the "West line of section 1, Township 4 South, Range 10 West, S. B. M.," as shown on said map with the westerly prolongation of the southerly line of lot 2 of said Tract; thence northerly 199.52 feet along said West line; thence easterly 197.32 feet parallel with the North line of said lot 4; thence southerly parallel with said West line to the southeasterly line of said lot 4 which has been construed by former deeds to be the center line of the unnamed street now known as Placentia Boulevard; thence southwesterly along said south- easterly line to the said westerly prolongation of the southerly line of said lot 2; thence westerly 85.90 feet along said prolongation to the point of beginning; be excluded from the R -A, RESIDENTIAL AGRICULTURAL, ZONE and incorporated in the following zone: C -1, NEIGHBORHOOD COMMERCIAL, ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit 1" on file with the City of Anaheim. 2. That landscaping shall be provided and main- tained in those areas indicated on plans marked "Exhibit 1" on file with the City of Anaheim; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim; and that said landscaping shall be installed prior to final building inspection. -2- 3. (a) That 6..foot masonry walls shall be con- structed along the north and east boundaries of subject property, with the exception of a 30 -foot section along the north boundary where the proposed easement along the east boundary abuts the landlocked parcel of land to the north; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said walls. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width from the center line of the street, along Placentia Avenue, for street widening purposes. (a) That all engineering requirements of the City of Anaheim, along Cypress and Placentia Avenues, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satis- factory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Cypress and Placentia Avenues, for street lighting purposes. 7. That the owners of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 8. That areas adequate for trash storage and pickup shall be provided, as determined and required by the Public Works Department of the City of Anaheim. 9. That Conditions Nos. 3 (b), 14, 5 (b), 6 and 7 above mentioned shall be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
