1961-7335RESOLUTION NO. 7335 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 162. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from Raymond G. Simpson and Alice E. Simpson, 2)0)11 Riverside Drive, Santa Ana, California, to expand and operate an existing trailer park situated on the following described property: All that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at a point on the East line of the Southwest quarter of the Southwest quarter of Section 23, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a map thereof recorded in book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County, 409.55 feet South of the Northeast corner of the Southwest quarter of the Southwest quarter of said Section 23, and running thence South along said East line, 482.16 feet; thence South 45° 06t 30" West parallel to the North- westerly line of that certain parcel of land conveyed to E. 3. Reeves and H. F. Reeves, by deed recorded in book 358, page 20, Deeds, records of said Orange County, 359.30 feet to a point in the center line of the 60 -foot state highway, as originally laid out; thence Northwesterly along said center line, 342.56 feet; thence North 45° 06t 30" East parallel to the Northwesterly line of that certain parcel conveyed to said E. J. Reeves, 673.81 feet to the point of beginning; EXCEPTING THEREFROM the following: Beginning at a point on the East line of the Southwest quarter of said Section 23, 709.66 feet South of the North- east corner of the Southwest quarter of the Southwest quarter of said Section 23, and running thence South along the said East line, 182.05 feet; thence South 45 06t 30" West parallel to the Northwesterly line of that certain parcel of land conveyed E. J. Reeves and H. F. Reeves, by deed recorded in book 358, page 20, Deeds, records of said Orange County, 359.30 feet to a point in the center line of the 60 -foot state highway, as originally laid out; thence Northwesterly along said center line, 129.00 feet; thence North 45° 06t 30" East parallel to the Northwesterly line of that certain parcel con- veyed to said E. J. Reeves, 478.85 feet to the point of beginning; ALSO EXCEPTING THEREFROM the following: Beginning at a point on the center line of the 60 -foot strip of land described in the deed to the State of California, recorded in book 258, page 66, Deeds, records of said Orange County, distant North -1- 40° 50' 15" West 409.24 feet from the inter- section of said center line with the center line of Katelia Avenue, 60 feet wide, (being the South line of said Section 23); thence at right angles North 49° 9: 45" East, 116.58 feet; thence North 78 19' 45" East 15.10 feet to the point of tangency of this course with a curve concave southerly having a radius of 450 feet; thence Easterly along said curve to the South- easterly line of the parcel of land conveyed to K. E. Reed, et ux., by deed recorded in book 1452, page 387, Official Records, in the office of the County. Recorder of said Orange County; thence Southwesterly along said Southeasterly line to the center line of said 60 -foot strip of land; thence along said center line, North 40° 50' �5" West to the point of beginning, as granted to the State of California, by deed recorded March 3, 1952, in book 2296, page 158, Official Records, in the office of the County Recorder of said Orange County; AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on September 18, 1961, notices of which said public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 91, Series 1961 -62, granting Conditional Use Permit No. 162 subject to the condi- tion therein set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 7th day of November, 1961, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Condi- tional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. ATTEST: 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detri- mental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the condition imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 162 be, and the same is hereby, granted permitting the expansion and operation of an existing trailer park situated on the property hereinabove described, subject to the fol- lowing condition: That said property shall be developed or expanded substantially in accordance with plans marked "Exhibits 1, 2 and 3" on file with the City of Anaheim. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the condition herein.
