1962-0261WHEREAS, the Cities of Anaheim and Santa Ana and
Orange County Municipal Water District are interested in,
and have capacity rights in, that certain pipeline commonly
known as the East Orange County Feeder No. 2 when, as, and
if said pipeline shall be completed; and
WHEREAS, it is the mutual desire of said Cities
and said Water District that no assignment of capacity in
said line be made by said Cities and said District or any
of them except for value received and upon a payment basis
comparable to that paid by previous purchasers of such
capacity from Orange County Municipal Water District; and
WHEREAS, said Cities and said Water District desire
to enter into an agreement to the effect that none of said
parties shall hereafter assign any capacity rights in said
East Orange County Feeder No. 2 which such party may have
except for value received and upon a payment basis comparable
to that paid heretofore by purchasers of capacity in said
line in acquisition of capacity from Orange County Municipal
Water District; and
WHEREAS, a form of agreement has this day been ten-
dered to the City Council to be made and entered into by and
between the Cities of Anaheim and Santa Ana and said Water
District with reference to the assignment of said capacity
rights, which agreement the City Council finds would be for
the benefit and best interest of the City and should be
approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement this day tendered
to the City Council to be made and entered into by and between
the City of Anaheim, the City of Santa Ana, and the Orange
County Municipal Water District, wherein each of the parties
agrees with each of the other parties that none of said parties
shall hereafter assign any capacity rights in said East Orange
County Feeder No. 2 which such party may have except for value
received and upon a payment basis comparable to that paid here-
tofore by purchasers of capacity in said line in acquisition
of capacity from Orange County Municipal Water District, be,
and thesame is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
