1962-0175RESOLUTION NO. 62R -175 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 -70 to consider an amendmen* to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from v rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that twin. zone or zones be changed as hereinafter'set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City F,anv ning Commission, the City Councii did fix the 20th day of February 1962 as the time, and the pity Council cham- bers in the City SETT the City of Anaheim as the place fur a public hearing upon said propoaed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at aid public hearing before the Planning Commission, its repot of t` ndings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -70 That portion of lot 27 of Anaheim Extension, in the city of Anaheim, county of Orange, state of California, as shown on a map of Survey made by William Hamel and filed in the office of the county recorder of Los Angeles County, California, a copy of which is shown in book 3 page 163 et seq., entitled "Los Angeles County Maps," records of said Orange County, described as follows: Beginning at the intersection of the northerly prolongation of the westerly line of the land described as Parcel 1 in Certificate of Title No. 10356, with the cen ±er line of Vermont Avenue, said point being North 75 28 00" East 612.09 feet from the inter- section of said center line of Vermont Avenue with the center line of Palm Street as shown on a map filed in book 11 page 44 of Record of Surveys; thence North 75 28 00" East 58.00 feet to the northerly prolongation of the westerly line of the land described in Certificate of Title No. 13618; thence South 14 26 00" East 177.00 feet along said westerly line; thence North 75 28 00" East 52.00 feet parallel with said center line of Palm Avenue; thence North 14 26 00" West 20.00 feet parallel with said westerly line; thence North 75 28 00" East 40.00 feet parallel with said center line; thence South 1h° 26' 00" East 100.00 feet parallel with said westerly line to the easterly prolongation of the southerly line of the land described in said Parcel 1 of Certificate No. 10356; thence South 75 28 00" West 150.00 feet to the southwest corner of the land described in said Parcel 1; thence North 14 26 00" West 257.00 feet to the point of beginning. EXCEPT that portion within Vermont Avenue. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in the R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of $2 per front foot along Vermont Avenue for street lighting purposes. 2. That sidewalks shall be installed along Vermont Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. (a) That the curbs and gutters on Vermont Avenue shall be repaired as required by the City Engineer, and shall conform to standard plans and specifi- cations on file in the Office of the City Engineer; and (b) That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the repair of said curbs and gutters, and the installation of the sidewalks mentioned in Condition No. 2 hereof. -2- 4. That the owners of subject property shall pay to the City of Anaheim the sum of $25 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 5. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by asolid fence or wall prior to final building inspection. 6. That a 6 -foot masonry wall shall be constructed along all boundary lines of subject property, except along the Vermont Avenue frontage and along the most easterly boundary of subject property where said property abuts R -3, Multiple Family Residential Zone property; and that said wall shall be constructed prior to final building inspection. 7. That garages 10 feet by 20 feet in size shall be provided as required by the Anaheim Municipal Code. 8. That subject property shall be developed in accordance with Anaheim Municipal Code requirements for R -3, Multiple- Family Residential Zones. 9. That Conditions Nos. 1, 2 and 3 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
