1962-0109and wife, RESOLUTION NO. 62R 109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, EDWARD A. ESTRADA and FSTHF.R H_ F.STRAUA, husband are the owners of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of California,; and WHEREAS, said owners have offered to sell said property to the City of Anaheim for the.sum of _112,200.00 cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said real property for municipal purposes, and that the price which the owners thereof are willing to accept is reasonable and not out of proportion to the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Edward A. Estrada and Esther H. Estrada. husband and wife. Finance Dir R/w to self to the City of Anaheim all that real property situated ira. the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lots 17 and 18 of the Mary Goodman Tract, in the City of Anaheim, as per map recorded in Book 7, Page 21 of Miscellaneous Maps, records of Orange County, California, for the sum of $12,200.0.0 a cash, lawful money of the United States, be, and t e same is 1 ereby, accepted subject to the following terms and conditions: 1. That said property shall be conveyed to the City of Anaheim free and clear of all en- cumbrances except the second half of all general and special taxes for the fiscal year 1961 -62, including any special district levies, payment of which is included therein and collected therewith; all taxes and assessments levied or assessed subsequent to _the date the escrow, here inaf *.er referred to, is entered into between Buyer 7 and,Sellers; and all covenants,-conditions, r y s, reserltati9ns,,- rights, rights of. iay n d on easements of _record approved by the Ci,y Attorney. 2. That the Sellers shall pay that portion of the second half of the taxes for the fiscal year .961-62 on 'subject property from January 1, 1962, to date the deed to the City of Anahe irn i_,s recorded. BE IT FURTHER RESOLVED that the City Man the City Attorney of the City of Anaheim be, and either of`them is on behalf of the City f Anaheim to sign i ign escrow l on nstrucLt i f o.r the purchase of ss o fd lea 1,prop° g erty and to enter escrow with the owner sad ,property at United California Bank, Anaheim Office, Anaheim, California. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, authorized to deposit in escrow at said United California Bank $1.2,200.00 cash, lawful money of the United States, to be paid to the owners of said real property when a deed conveying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be recorded and a policy of title insurance issued by Title Insurance and Trust Company, 800 North Main, Santa Ana, California, showing said property vested in the City of Anaheim as hereinabove specified. AND BE IT FURTHER RESOLVED that the Buyer shall pay all escrow fees in the purchase of said property, including the charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, the U. S. Internal Revenue stamps required to be affixed to the deed, etc. (Costs of reconveyance to be paid by Sellers.)
