56R-3351 - ,-. RESOLUTION NO. 3351 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AWARDING A CONTRACT TO C. V. TAORMINA, OOING BUSINESS AS ANAHEIM DISPOSAL COMPANY, AS AN INDEPENDENT CONTRACTOR, TO COLLECT, PICK UP, .AND DISPOSE OF ALL RUBBISH AND TRASH IN A CERTAIN AREA IN THE CITY OF ANAHEIM; FIXING HIS COMPEN- SATION AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO A CONTRACT WITH HIM FOR AND ON BEHALF OF THE CITY OF ANAHEIM. WHEREAS, C. V. Taormina, doing business as Anaheim Disposal Company, has submitted to the City Council an offer to collect and dispose of all commercial rubbish and waste material within certain limits in the City, for the period com- mencing July 1, 1956 and ending June 30, 1958, for the flat sum of $750.00 per month, as full compensation for furnishing all labor, equipment and materials and for performing and completing all the work which is necessary or proper to be furnished or performed in order to collect and dispose of all rubbish and waste materials in the area specified, which area may, at the option of the Superlntendent of Streets be extended or altered, and the compensation payable to said C. V. Taormina adjusted accordingly; and WHEREAS, the City Council finds that it would be to the advantage and for the best interest of the City of Anaheim to enter into a contract with the said C. V. Taormina, doing business as Anaheim Disposal Company, for the collection and disposal of commercial rubbish and waste. materials; and WHEREAS, the said C. V. Taormina, doing business as Anaheim Disposal Company has submitted to the City of Anaheim a form of contract dated June 27, 1956 to be made and entered into by and between the City of Anaheim and said C. V. Taormina, doing business as Anaheim Disposal Company, for the collection and disposal of commercial rubbish and waste material in the limits shown on a map attached to said agreement, containing terms, provisions and conditions satisfactory to the City Council; ~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a contract be, and the same is hereby, awarded to C. V. Taormina, doing business as Anaheim Disposal Company, for the furnishing of all labor, equipment and materials and for the performance and completion of all work which is necessary or proper to be furnished or performed for the col- lection, removal and disposal of all commercial rubbish and waste material from within that portion of the City of Anaheim as is contained in the limits as shown on a map attached to and made a part of the agreement above mentioned, dated June 27, 1956, and this day submitted to the City Council by C. V. Taormina, doing business as Anaheim Disposal Company, which limits may, at the option of the Superintendent of Streets of the City of Anaheim be extended or altered and the compensation payable to said C. V. Taormina adjusted accordingly, for the term July 1, 1956 to June 30, 1958, and upon the express terms and conditions as set forth in the agreement dated June 27, 1956, this day submitted to the City Council, which agreement is hereby approved. -1- ~" .- AND BE IT FURTHER RESOLVED that the City shall pay said contractor as full compensation for furnishing all labor, equipment and materials and performing and completing all work necessary for the collection and disposal of said rubbish and waste material in accordance with,the terms and provisions of said contract, the sum of $750.00 per month, payable on the lOth day of each and every month for all materials and equipment furnished and labor performed for the preceding calendar month for the period from July 1, 1956 to June 30, 1958. BE IT FURTHER RESOLVED that said C. V. Taormina be, and he is hereby, required at the time of the execution of said contract to furnish the City a good and sufficient surety bond approved by the Superintendent of Streets and the City Attorney in the sum of $10,000.00 conditioned upon the faithful perform- ance of said contract and that said C. V. Taormina be, and he is hereby, required to furnish the City an additional good and sufficient surety bond in the sum of $5,000.00 conditioned upon the prompt payment by said contractor of all just and legal claims for materials and labor or obligations of whatever nature arising directly or indirectly for the performance of the work herein authorized and provided for and as specified in said contract. This bond shall likewise be approved by the Superintendent of Streets and the City Attorney. BE IT FURTHER RESOLVED that said C. V. Taormina be, and he is hereby required to carry at his own expense full coverage Workmen's Compensation Insurance covering all persons employed by him, and public liability insurance in an amount not less than $100,000.00 fQr injuries including accidental death for one person and subject to the same limits for each person in an amount not less than $300,000.00 on account of any one accident, and property damage in an amount not less than $50,000.00; that said public liability and property damage insurance shall cover both general liability of said contractor and all vehicles used by him in the performance of said contract. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby, authorized and directed to execute a contract in the form this day submitted to the City Council for and on behalf of the City of Anaheim with said C. V. Taormina, doing business as Anaheim Disposal Company, for the collection, removal and disposal of rubbish and waste material within the City Limits of the City of Anaheim as herein provided.
