Calitorn1a--- f-67the construction, installation and oompletion of said ~~h Citron 'treet im~rovement - Pro~ect No. 48 lieJ:Jeina1::iovementioned and de"'8Cr1.bed was the- lowest -responsible- pro- posal submitted therefor, and thereupon accepted said bid and did award a contract to said Sullz-Miller Con~racting C9mpany ____ for furnishing all plant, labor, services, materials and equip- ment and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and .rorkmanlike manner, in strict accordance with the specifications, plans, and drawings, the said public improvement as specified in said notice inviting sealed proposals, and did authorize the Mayor and the City Clerk of the City of Anaheim to execute a contract for and on behalf of the City of Anaheim with Sully-Miller Contraoting Company which said contract was dulYiiiade and-en-tered intonon-tne 20'1:.11 day of Mar~_____, 19-2i.; and -~ WHEREAS, the said Sully-Miller Oontracting Company has furnished all plant, labor, services, materials and equip- ment and all utilities and transportation, and performed all work necessary for the construction and completion, in a good and workmanlike manner in strict accordance .rith the specifications, plans and drawings, of said public improvement as specified in the notioe inviting sealed proposals and in the detail, design, plans, profiles, drawings and speoifications prepared by Geor~e E. Holyoke! Clli_En~ineer______., and the contract made and entered into "rn;n- t oy the City of Anaheim; and ,v'HEREAS, the Oi ty Engineer _______ hRS dUly certified to the Gonstruction and completion of said puolic improvement hereina~ove mentioned and described in accordance with the plans and specifications and the contract documents duly made and entered into Tlith said Sulll~ler -.QQllU'&CU!!~LQ.Q!m~__._; and dHEREAS, the City Council finds that said contractor has completeQ said public improvement hereinabove more particu- larly described in accordance with the provisions of the contract and the contract documents, and that notice of completion should be filed and payment of thG balance due said contractor authorized in accordance with the contract documents. -2- ~ .r- i r_ NO\i[, TREREFOJ.I:, 3i, IT RESOLVED by the City Council of the City of Anaheim that all plant, labor, services, materials '-t;l(l dquipmont and all ntilities and trans-qortation, and the per- formance of all work nocessary to construct, install and cOlllpletw in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clark of the City of Anaheim together with the ap- p~tenances thereto of said public improvement h~reinabovo more particularly describod and set forth, in the City of Anaheim, by salid contractor, be, and tho sarno is hereby, accepted, subject, ne"ertheless, to all the terms, cor,di tians and provisions of tho contract documents. and that the balanco due said contractor for said work bo paid to it thirty-five (35) days from and after final acceptance of sa1]rwork as evidenced by tho adoption of this resolution, but not sooner than thirty ()O) days after the date of the filing of notice of completion, excepting only such sum or sums as may lawfully be withheld in accordance with the pro- visions of said contract and contract documents. That acceptance by the oontractor of said payments made in aocordanoewith said final estimate shall operate and shall be a release to the City of Anaheim, its officers, agents and employees from all claims and liablli ties due the contractor for anything done or furnished or withheld or for anything relating to the work or any act or neg- lect of the City, its offioers, agents and employees, ,exoepting only claims against the City for any amounts withheld by the City at the time of such payment. AND BE IT FURTHER RESOLVED that thaMayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized to execute and file a notice of completion of said work as ro~ qu1red by law.
