RESOLUTION NO. 3343
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ANAHEIM GRANTING
A SPECIAL USE PERMIT.
WHEREAS, on or about the 21st day of May, 1956,
the City Planning Commission of the City of Anaheim did
receive an applioation from DONALD D. WELLS, of Ivan Wells
Be Sons, 2368 Houston Street, Anaheim, California, for a
special use permit to construot a swimming pool, clubhouse,
and accessory buildings on the following described property:
Lots 102, 103 and 104
of Tract No. 2659.
AND WHEREAS, said Planning Commission did thereupon
give legal notice that it would hold a pUblic hearing in City
Council Chamber in the City Hall of the City of Anaheim on
Monday, June 4, 1956, at the hour of 2:00 o'olock P.M. to
review said application for said proposed use, and notified
all interested persons to attend said hearing and express
opinions for or against the granting of said special use per-
mit, and did cause said notice to be published on May 29,
1956, and did cause notice thereof to be given by mailing a
postal card notice not less than 10 days prior to the date
of subject hearing to the owners of property within a radius
of )00 feet of the exterior boundaries of the property for
whioh such speoial use permit Was requested, using for that
purpose the last known name and address of subject owners as
shown upon the assessment roll of Orange County, which said
postal cards did contain information as to the time and place
where said hearing would be held, and the purpose of said
hearing, and notify all persons interested therein to appear
and express opinions either for or against the granting of
said special use permit; and
WHEREAS, on the 4th day of June, 1956, the Oity
Planning Oommission did meet in regular session and did hold
and conduct a pUblic hearing upon said application for said
speoial use permit and did reoeive evidence and reports from
all persons who appeared at said meeting and offered evidenoe
or expressed opinions, and said Planning Commission did there-
upon adopt its Resolution No. 204 -- Series 1955-56, granting
said special use permit subject to the conditions therein
stated; and
WHEREAS, within 20 days from and after the date of
the adoption of said resolution the City Council did elect
upon its own motion to review the amtion of the City Planning
Commission; and
WHEREAS, the City Council finds, after oareful oon-
sideration of the recommendations of the City Planning Com-
mission, that said special use permit should be granted upon
the terms and conditions hereinafter set forth.

NOW, THEREFORE, BE IT RESOLVED by the City Counoil
of the City of Anaheim that the action of the City Planning
Commission granting a special use permit to Donald Wells of
Ivan Wells & Sons, 2368 Houston Street, Anaheim, California,

to construct a swimming pool, clubhouse, and accessory
buildings on the property hereinabove described, be, and
the same is hereby ap:)roved and that said special use
permit be, and the same is hereby granted subject to the
following conditions:
1. That a 6-foot masonry wall be erected
surrounding the facilities;
2. That a 4-foot setback be allowed from
the sidewalk to the front property
line;

J. That subject facilities shall not be
rented out to any others not living
in Tract No. 2659;
4. That all engineering requirements of
the City of Anaheim be complied with
as required by the City Engineer.
The City Counoil hereby reserves the right to revoke
such special use permit for good cause or failure of said
owner or his heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
Said special use permit is granted for the term prescribed by
the Anaheim Municipal Code unless otherwise speoified herein.
