RESOLUTION NO. 3309
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUISI'fION OF CERTAIN RJ.:AL PROPERft
FOR PUBLIC PURPOSES.
WHEREAS, RU8se~ O. Roquet and Dorot~ Roquet,
husband and wife, are the owners of the hereinafter de-
soribed real property situated in the City of Anaheim,
County of Orange, state of California; and
WHEREAS, said owners have offered to sell said
property to the City of Anaheim for the sum of $48,187.50,
cash, lawful money of the United States; and
WHEREAS, the City Council does find and determine
that pUblic convenienoe and necessity require the purchase
and acquisition of said parcel of real property for public
purposes, and that the price whioh the owners thereof are
willing to accept is reasonable and not out of proportion
to the fair market value of said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer ot Russel O. Roquet
and Dorothy Roquet to sell said property, situated in the
City of Anaheim, County of Orange, state of California, de-
scribed as follows, to wit:
Lot 21 of the Golden State Tract No. 2
located in the City of Anaheim, County of
Orange, state of California, as shown on
a map filed in Book 4, page 68 of Misoel-
laneous Maps in the Offioe of the County
Recorder of said Orange County, California;
EXCEPTING therefrom the northerly 150 feet,
for the sum of $48,187.50 cash, lawful money of the United
States, be, and the same is hereby acoepted, subjeot to the
following terms and conditions:
1. That sellers are to retain the orange orop
now growing on said property, and are to
harvest said crop on or before July 10, 1956.
2. Possession of said property is to be given
at the close of escrow, provided said esorow
is not closed before July 10, 1956. ShOUld
said escrow be oompleted and olosed before
July 10, 1956, then and in that event Sellers
shall retain possession of said property
until July 10, 1956.
J. That subjeot property shall be conveyed to
the Oity of Anaheim free and clear of all
enoumbrances except al~ taxes for the fiscal
year 1956-57, a ~ien not yet payab~e, and
covenants, conditions, restrictions, reser-
vations, rights, rights-of-way and easements
of record.

4. It is understood that the sale of subject
property is contingent upon the consummation
of Escrow #92-5443 at the Security First
National Bank of Los Angeles, Fullerton,
California.
BE IT FURTHER RESOLVED that the City Administrator
of the City of Anaheim be, and he is hereby, authorized for
and on behalf of the City of Anaheim to sign escrow instruct-
ions for the purchase of said real property and to enter into
an escrow with the owners of said property at Security First
National Bank of Los Angeles, Fullerton, California.
AND BE IT FURTHER RESOLVED that the City Treasurer
be, and she is hereby, authorized to deposit in escrow at
Security First National Bsnk of Los Angeles, Fullerton,
California, the sum of $48,187.50 oash, lawful money of the
United States, to be paid to the owners of said real property
when a deed oonveying said property to the City of Anaheim
free and clear of all encumbranoes, except as hereinabove set
forth, can be recorded and a pOlioy of title insurance issued
by a reputable~tle company showing said property vested in
the City of Anaheim free and clear of all encumbranoes as
herein specified.
AND BE IT FURTHER RESOLVED that the sellers shall
pay the usual and oustomary sellers' charges for furnishing
a policy of title insurance neoessary to ahow title vested in
the City of Anaheim, as herein prOVided, and tha~ the City of
Anaheim shall pay the usual buyer's share in the purchase of
said property.
THE FOREGOING RESOLUTION is signed and approved by
me this 29th day of May, 1956.
