RESOLUTION NO. 62R -372
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM STIPULATING WITH THE
PUBLIC UTILITIES COMMISSION IN CONNECTION
WITH THE PURCHASE OF THE "HEINER TRACT"
FROM THE PACIFIC WATER COMPANY,,
WHEREAS, the City of Anaheim did enter into a
contract for the purchase of a part of the water utility
properties of the Pacific Water Company commonly referred
to as the "Heiner Tract and
WHEREAS, in connection with such contract of
purchase and sale, it was necessary to obtain an order from
the Public Utilities Commission of the State of California;
and
WHEREAS, the purchase and sale was approved by the
said Public Utilities Commission subject to, the condition
that the City of Anaheim file with the Commission "a certified
copy of a stipulation to the effect that said City has
acquired the property conveyed pursuant to the aforementioned
agreement, subject to all legal claims for water service
which might have been enforced against Pacific Water Co..,
including such claims as may exist in territory outside the
boundaries of said City. and
WHEREAS, the contract of purchase and sale has been
consummated in accordance with the terms thereof;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim does hereby stipulate and agree that
the water utility properties acquired from the Pacific Water
Company by contract of purchase and sale in conformity
with the order of the Public Utilities Commission of the
State of California commonly known as the "Heiner Tract" has
been acquired by the City of Anaheim pursuant to the agree-
ment filed with the Public Utilities Commission and it is
hereby stipulated that the City of Anaheim has acquired such
property subject to all legal claims for water service which
might have been enforced against Pacific Water Co., including
such claims as may exist in territory outside the boundaries
of said City.
BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby instructed to forward a certified copy of this
resolution to the Public Utilities Commission of the State of
California.
THE FOREGOING RESOLUTION is approved and signed by
me this 17th day of April, 1962.

NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: Schutte.
AND I FURTHER CERTIFY that the Mayorcof the City of
Anaheim approved and signed said No. 62R -372 on the
17th day of April, 1962.
