1962-0804RESOLUTION NO. 62R-804 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NOo_12 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Charles S. and Margaret Elardi owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of lot 3 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a Map of Survey made by William Hamel and filed in the Office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3 page 163 et seq., entitled "Los Angeles County Maps', Records of said Orange County, described as follows: Beginning at the southwest corner of said lot (for the purposes of this description the southeasterly line of said lot is assumed to be the center line of Sycamore Street adjoining said lot on the southeast); thence North 16° 24 00" West 199.75 feet to the true point of beginning; thence continuing North 16° 24 00" West 120.07 feet to the south- west corner of Tract No. 3328, as per Map recorded in Book 110 page 31 of Miscellaneous Maps, in the office of the county recorder of said Orange County; thence North 74° 30 30" East 297.33 feet along the southeasterly line of said Tract to the southwesterly corner of the land described in Certificate No. 5905 filed in the office of the Registrar of Titles in the office of said county recorder thence South 17 30 30" East 180.25 feet to the northeasterly corner of the land conveyed to Evelyn V. Jennings by deed recorded August 3, 1954 in book 2783 page 516 of Official Records of said Orange County; thence southwesterly 124.765 feet along the northwesterly line of said land of Jennings and its southwesterly prolongation; thence South 16° 24 00" East 139.75 feet to the southeasterly line of said lot; thence southwesterly 54.765 feet along said southeasterly line to a point northeasterly 124.00 feet from the point of begin- ning; thence North 16° 24 00" West 199.75 feet to a point North 74 30 30" East 12)1.00 feet from the true point of beginning; thence South 74 30 30!' West 124.00 feet to the true point of beginning. EXCEPT the southeasterly 24.75 feet included within Sycamore Street. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on August 6, 1962 notice of which said public hearing was duly given as required by law and the provi- sions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. )I)I0 Series 1962 -63 recommending that Variance No.____1LL12,be granted sub,ject,to certain conditions therein set forth ;and -1- WHERLAS, thereafter, within twen„y -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in ranting said variance and did set a public hearing thereon to bee held on the 41h day of September 1962 at 7 :00 o'clock P.M. in the City Hall in the City.or Anaheim and notice of such. public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the minimum side yard building setback and parking requirements on the property hereinabove described, subject to the following conditions: That said Variance No. 1512 is granted subject to the conditions set forth in Resolution No. 62R -803, adopted by the City Council on September 4, 1962 in Reclassifi- cation Proceedings No. 62- 63 -10, with the exception of Condition No. 9, which shall not apply, and subject to the completion of said reclassification proceedings. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: Schutte. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said resolution on the 4th day of September, 1962.
