1962-0803RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELA1ING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 -63 -10 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the lath day of September 19 62 as the time and the City Council Chambers in the City Hall of t e City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of lot 3 of Anaheim Extension, in the city of Anaheim, county of Orange, state of California, as shown on a map of survey made by William Hamel and filed in the office of the county recorder of Los Angeles County, California, a copy of which is shown in book 3 page 163 et seq., entitled "Los Angeles County Maps", records of said Orange County, described as follows: -1- 62R -8o3 62 -63 -10 Beginning at the southwest corner of said lot (for the purposes of this description the south- easterly line of said lot is assumed to be the center line of Sycamore Street adjoining said lot on the southeast); thence North 16 �4t 00" West 199.75 feet to the true point of beginning; thence continuing North 16° 241 00" West 120.07 feet to the southwest corner of Tract No. 3328, as per map recorded in book 110 page 31 of Miscellaneous Maps, in the office of the county recorder of said Orange County; thence North 74 30 30" East 297. 33 feet along the southeasterly line of said Tract to the southwesterly corner of the land described in Certificate No. 5905 filed in the office of the Registrar of Titles in the office of said county recorder thence South 17 30 30" East 180.25 feet to the north- easterly corner of the land conveyed to Evelyn V. Jennings by deed recorded August 3, 1954 in book 2783 page 516 of Official Records of said Orange County; thence southwesterly 124.765 feet along the northwesterly line of said land of Jennings and its southwesterly prolongation; thence South 16° 241 00 East 139.75 feet to the south- easterly line of said lot; thence southwesterly 54.7 feet along said southeasterly line to a point northeasterly 124.00 feet from the point of beginning; thence North 16 24 00" West 199.75 feet to a point North �4 30 30" East 124.00 feet from the true point of beginning; thence South 74 30 30" West 124.00 feet to the true point of beginning. EXCEPT the southeasterly 24.75 feet included within Sycamore Street. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorpo- rated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Sycamore Street for street widening purposes. 2. That sidewalks and driveways shall be constructed on Sycamore Street as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer, and that said sidewalks and driveways shall be constructed prior to final building inspection. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Sycamore Street, for street lighting purposes. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined andrequired by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. -2- 10. That Conditions Nos. 1 and 3 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is signed and approved by me this 4th day of September, 1962. ATTEST: CI' Y CLERK OF THE CITY OF ANAHEIM -3- That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permits are issued. 6. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits Nos. 1 and 2" on file with the City of Anaheim, except that the turning area in front of the garages shall be a minimum of 26 feet. 7. That a 6 -foot masonry wall shall be constructed along the westerly 124 feet of the south property line and along the easterly 124.76 feet of the south property line, also along the west property line from the .southerly edge of the garages to the front setback line, and along the east property line for a distance of 14.0 feet to separate the parking area from the adjacent R -A Zone property. YOR OF THE CITY OF ANAHEIM 9. That the completion of these reclassification proceedings is contingent upon the granting of Variance No. 1512. 8. That in lieu of garages, there shall be provided 25 carports, that the interior walls of the carports shall be stuccoed, where masonry walls do not exist; that enclosed storage area shall be provided along the rear wall of each carport; and that adequate bumper guards shall be provided to protect the rear of the carports.
